       Introduced  by  Sen.  KRUGER -- read twice and ordered printed, and when
         printed to be committed to the Committee on Local Government
       AN ACT to amend the general municipal law,  in  relation  to  rights  of
         action  to  certain  injured  or  representatives  of certain deceased
         police officers
         THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section  1.  Section  205-e of the general municipal law is amended by
    2  adding a new subdivision 4 to read as follows:
    3    4. NOTHING CONTAINED IN THIS SECTION SHALL BE INTERPRETED AS  PRECLUD-
    4  ING  ANY  OFFICER,  MEMBER,  AGENT, OR EMPLOYEE OF ANY POLICE DEPARTMENT
    5  INJURED OR WHOSE LIFE MAY BE LOST WHILE IN THE DISCHARGE OR  PERFORMANCE
    6  OF  DUTY  OUTLINED IN SUBDIVISION ONE OF THIS SECTION, OR THE SPOUSE AND
    7  CHILDREN, OR THE PARENTS, OR THE BROTHERS AND SISTERS, BEING THE SURVIV-
    8  ING HEIRS-AT-LAW OF ANY DECEASED PERSON THUS HAVING LOST HIS LIFE,  FROM
    9  HOLDING  THE PERPETRATOR OF AN ACTION WHICH RESULTS IN INJURY, A DISEASE
   10  WHICH MAY RESULT IN DEATH, OR WRONGFUL DEATH LIABLE FOR CIVIL DAMAGE.
   11    S 2. This act shall take effect immediately.
