DeFRANCISCO, GRIFFO, JOHNSON, LARKIN, MAZIARZ, RANZENHOFER -- read twice and ordered printed, and when printed to be committed to the Committee on Finance AN ACT to amend the New York state printing and public documents law and the state technology law, in relation to agency reports THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: 1 Section 1. Subdivision 4 of section 12 of the New York state printing 2 and public documents law, as added by chapter 524 of the laws of 2005, 3 is amended to read as follows: 4 4. (a) Whenever state law requires a state agency to make, issue, 5 submit, deliver, distribute or forward a report to the "legislature" or 6 to "members of the legislature" or to "both houses of the legislature," 7 or to any particular legislative officers or chairpersons of legislative 8 committees, subcommittees or commissions, the agency shall satisfy such 9 requirement by [either]: 10 (i) making[, issuing, submitting, delivering, distributing or forward- 11 ing a printed copy of the report to each member of the legislature, or 12 to the specified legislative officers or chairpersons, as the case may 13 be; or] SUCH DOCUMENT AVAILABLE ON THE NEW YORK STATE AGENCY DOCUMENTS 14 WEBSITE, AS AUTHORIZED BY SUBDIVISION EIGHTEEN OF SECTION ONE HUNDRED 15 THREE OF THE STATE TECHNOLOGY LAW, UNDER THE APPROPRIATE AGENCY'S HEAD- 16 ING AND SENDING A PRINTED LETTER OR NOTICE TO EACH MEMBER OF THE LEGIS- 17 LATURE, OR TO THE SPECIFIED LEGISLATIVE OFFICERS OR CHAIRPERSONS, AS THE 18 CASE MAY BE, INDICATING THE AVAILABILITY OF SUCH REPORT ON THIS WEBSITE; 19 AND 20 (ii) making such document available on its website and sending a 21 printed letter or notice to each member of the legislature, or to the 22 specified legislative officers or chairpersons, as the case may be, 23 indicating the availability of such report on the agency's website. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD04879-01-1 S. 2899 2 1 (b) Such letter or notice shall include the name of the specific 2 report, the specific web address at which the report can be accessed or 3 instructions on how to access the report from the agency's homepage, and 4 the name of the person at the state agency to whom the legislator may 5 direct a request to obtain a printed copy of the report, free of charge, 6 if so desired. 7 S 2. Section 103 of the state technology law is amended by adding a 8 new subdivision 18 to read as follows: 9 18. TO ESTABLISH, ADMINISTER AND MAINTAIN A NEW YORK STATE AGENCY 10 DOCUMENTS WEBSITE WHICH WILL INCLUDE POSTINGS OF ALL REPORTS ISSUED BY 11 STATE AGENCIES, DEPARTMENTS, PUBLIC AUTHORITIES, PUBLIC BENEFIT CORPO- 12 RATIONS OR ENTITIES WHENEVER STATE LAW REQUIRES A STATE AGENCY TO MAKE, 13 ISSUE, SUBMIT, DELIVER, DISTRIBUTE OR FORWARD A REPORT TO THE "LEGISLA- 14 TURE" OR TO "MEMBERS OF THE LEGISLATURE" OR TO "BOTH HOUSES OF THE 15 LEGISLATURE", OR TO ANY PARTICULAR LEGISLATIVE OFFICERS OR CHAIRPERSONS 16 OF LEGISLATIVE COMMITTEES, SUBCOMMITTEES OR COMMISSIONS. IT SHALL BE THE 17 RESPONSIBILITY OF THE NEW YORK STATE AGENCY DOCUMENTS WEBSITE TO SERVE 18 AS THE CENTRAL REPOSITORY FOR THE POSTING AND ARCHIVING OF ALL DOCUMENTS 19 PROVIDED TO THE LEGISLATURE AS REQUIRED BY STATE LAW. 20 S 3. This act shall take effect on the ninetieth day after it shall 21 have become a law.
