       AN  ACT to amend the economic development law, in relation to establish-
         ing the New York state amateur sports development advisory council
         THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section  1.  The  economic  development law is amended by adding a new
    2  article 5-B-1 to read as follows:

    4         NEW YORK STATE AMATEUR SPORTS DEVELOPMENT ADVISORY COUNCIL
    5  SECTION 172-A. NEW YORK STATE AMATEUR SPORTS DEVELOPMENT ADVISORY  COUN-
    6                   CIL ESTABLISHED.
    7          172-B. PURPOSE OF THE COUNCIL.
    8          172-C. POWERS OF THE COUNCIL.
    9    S  172-A.  NEW  YORK STATE AMATEUR SPORTS DEVELOPMENT ADVISORY COUNCIL
   10  ESTABLISHED. 1.  THERE IS HEREBY ESTABLISHED IN THE DEPARTMENT  THE  NEW
   11  YORK  STATE  AMATEUR  SPORTS  DEVELOPMENT  ADVISORY  COUNCIL WHICH SHALL
   12  COMPRISE EIGHTEEN MEMBERS APPOINTED BY THE GOVERNOR, THREE ON THE RECOM-
   13  MENDATION OF THE TEMPORARY PRESIDENT OF THE SENATE; ONE ON THE RECOMMEN-
   14  DATION OF THE MINORITY LEADER OF THE SENATE; THREE ON THE RECOMMENDATION
   15  OF THE SPEAKER OF THE ASSEMBLY; AND ONE ON  THE  RECOMMENDATION  OF  THE
   16  MINORITY LEADER OF THE ASSEMBLY. THE MEMBERS OF THE COUNCIL  SHALL SERVE
   17  FOR  TERMS  OF  TWO  YEARS, PROVIDED, HOWEVER, THAT OF THE MEMBERS FIRST
   18  APPOINTED, NINE SHALL SERVE FOR TERMS OF TWO YEARS AND NINE SHALL  SERVE
   19  FOR TERMS OF THREE YEARS. THE GOVERNOR SHALL DESIGNATE THE CHAIRMAN FROM
   20  AMONG  THE  MEMBERS  OF  THE COUNCIL. THE VICE CHAIRMAN SHALL BE ELECTED
   21  FROM AMONG THE MEMBERS OF THE COUNCIL BY THE MEMBERS  OF  SUCH  COUNCIL,
   22  AND  SHALL  REPRESENT  THE COUNCIL IN THE ABSENCE OF THE CHAIRMAN AT ALL
   23  OFFICIAL COUNCIL  FUNCTIONS.  THE  CHAIR  OF  THE  SENATE  COMMITTEE  ON
        EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets

    1  CULTURAL  AFFAIRS,  TOURISM,  PARKS  AND RECREATION AND THE CHAIR OF THE
    2  ASSEMBLY COMMITTEE ON TOURISM, ARTS  AND  SPORTS  DEVELOPMENT  OR  THEIR
    3  DESIGNATED  REPRESENTATIVES,  SHALL BE NON-VOTING, EX OFFICIO MEMBERS OF
    4  THE  COUNCIL  AND  SHALL  RECEIVE  NO  ADDITIONAL COMPENSATION FOR THEIR
    5  SERVICES ON THE ADVISORY COUNCIL.
    6    2. IN APPOINTING THE MEMBERS OF THE COUNCIL, THE GOVERNOR SHALL ENSURE
    7  THAT SUCH MEMBERS INCLUDE REPRESENTATIVES OF ORGANIZATIONS THAT  SPONSOR
    8  AND  PROMOTE AMATEUR   SPORTS ACTIVITIES IN THE STATE INCLUDING, BUT NOT
    9  LIMITED TO, BUSINESSES, CONVENTION BUREAUS, CULTURAL INSTITUTIONS, PARKS
   10  AND ATTRACTIONS, SCHOOLS, CLUBS, COLLEGES AND UNIVERSITIES, RESTAURANTS,
   11  WATER-BASED RECREATION FACILITIES, CAMPGROUNDS, SKI  FACILITIES,  WINER-
   12  IES, HALLS OF FAME, TRAVEL AGENTS AND TRANSPORTATION COMPANIES.
   13    3.  THE MEMBERS OF THE COUNCIL SHALL RECEIVE NO COMPENSATION FOR THEIR
   14  SERVICES   BUT SHALL BE ALLOWED  THEIR  ACTUAL  AND  NECESSARY  EXPENSES
   15  INCURRED IN THE PERFORMANCE OF THEIR DUTIES AS COUNCIL MEMBERS.
   16    4. THE COUNCIL SHALL MEET AT LEAST FIVE TIMES A YEAR INCLUDING NO LESS
   17  THAN  THREE    TIMES  BETWEEN JANUARY FIRST AND MAY THIRTY-FIRST, AT THE
   18  CALL OF THE COMMISSIONER OR THE CHAIRMAN OF THE COUNCIL.
   19    5. UNLESS A MEMBER HAS BEEN EXCUSED FROM ATTENDANCE AT  SUCH  MEETINGS
   20  BY THE CHAIRMAN OR VICE-CHAIRMAN UPON GOOD CAUSE BEING SHOWN, ANY MEMBER
   21  WHO  FAILS TO  ATTEND THREE CONSECUTIVE MEETINGS SHALL BE DEEMED TO HAVE
   22  RESIGNED. ANY VACANCY ON THE COUNCIL SHALL BE FILLED FOR  THE  REMAINING
   23  TERM  OF  THE  INDIVIDUAL REPLACED. THE APPOINTMENT TO FILL SUCH VACANCY
   24  SHALL BE MADE IN THE SAME MANNER AS THE ORIGINAL APPOINTMENT WAS MADE.
   25    6. THE DEPARTMENT SHALL PROVIDE NECESSARY TECHNICAL AND STAFF  ASSIST-
   26  ANCE  TO THE COUNCIL.  ALL REASONABLE REQUESTS BY THE COUNCIL FOR INFOR-
   27  MATION, COOPERATION, OR ASSISTANCE TO CARRY OUT  THE  PURPOSES  OF  THIS
   28  ARTICLE  SHALL  BE  PROVIDED  BY  ANY OTHER DEPARTMENT, DIVISION, BOARD,
   29  BUREAU, COMMISSION, AUTHORITY OR AGENCY OF THE STATE.
   30    S 172-B. PURPOSE OF THE COUNCIL. THE PURPOSES OF THE COUNCIL SHALL  BE
   31  TO ADVISE THE COMMISSIONER CONCERNING AMATEUR SPORTS PROMOTIONS, TO LINK
   32  TOURISM  RESOURCES  TO  AMATEUR SPORTS PROMOTION AND TO SERVE AS LIAISON
   33  BETWEEN THE STATE'S AMATEUR  SPORTS  CLUBS  AND  ORGANIZATIONS  AND  THE
   34  COMMISSIONER  WITH RESPECT TO COORDINATING THE DESIGN AND IMPLEMENTATION
   35  OF THE STATE'S AMATEUR SPORTING EVENT PROMOTION POLICIES AND PROGRAMS.
   36    S 172-C. POWERS OF THE COUNCIL. THE COUNCIL SHALL HAVE  THE  FOLLOWING
   37  POWERS:
   38    1.  TO  IDENTIFY  AND  REVIEW  AMATEUR SPORTS ACTIVITIES, COORDINATING
   39  SCHEDULING AND USE OF VENUES, AND CURRENT STATE  POLICIES  AND  PROGRAMS
   40  WHICH  DIRECTLY  OR  INDIRECTLY AFFECT THE PROMOTION OF AMATEUR SPORTING
   41  EVENTS IN THE STATE AND, AS APPROPRIATE, RECOMMEND THE ADOPTION OF  NEW,
   42  OR THE MODIFICATION OF EXISTING, POLICIES AND PROGRAMS;
   43    2.  TO  ADVISE  THE  DEPARTMENT  IN  ITS  PROMOTION AND DEVELOPMENT OF
   44  AMATEUR SPORTING TOURNAMENTS AND EVENTS, FACILITIES AND RELATED SERVICES
   45  IN THE STATE; TO PROVIDE GUIDANCE    AND  ASSISTANCE  TO  LOCAL  AMATEUR
   46  SPORTS  CLUBS  AND  ORGANIZATIONS;  AND  TO PROVIDE CENTRAL INVENTORY OF
   47  VENUES, A STATEWIDE SCHEDULE OF AMATEUR SPORTING EVENTS  AND  A  CENTRAL
   48  RESOURCE FOR SUCH SPORTING EVENT INFORMATION;
   49    3.  TO  ADVISE THE DEPARTMENT IN THE DEVELOPMENT AND IMPLEMENTATION OF
   50  THE STATE'S AMATEUR SPORTS MARKETING AND BUSINESS  DEVELOPMENT  PROGRAM,
   51  INCLUDING  LONG-RANGE  STRATEGIES FOR ATTRACTING AMATEUR SPORTS ENTHUSI-
   52  ASTS TO THE STATE;
   53    4. TO ADVISE THE DEPARTMENT, THE GOVERNOR AND THE LEGISLATURE CONCERN-
   54  ING RECOMMENDED LEGISLATION NECESSARY TO FOSTER AND PROMOTE  THE  EXPAN-
   55  SION AND DEVELOPMENT OF AMATEUR SPORTING EVENTS WITHIN THE STATE;

    1    5. TO ADVISE THE DEPARTMENT, THE GOVERNOR AND THE LEGISLATURE CONCERN-
    2  ING  EXISTING  LAWS,  RULES, REGULATIONS AND PRACTICES OF STATE AGENCIES
    3  WHICH ARE COUNTER-PRODUCTIVE OR INIMICAL TO THE EXPANSION  AND  DEVELOP-
    4  MENT OF AMATEUR SPORTING EVENTS WITHIN THE STATE; AND
    5    6. TO ASSIST THE DEPARTMENT IN OBTAINING INFORMATION NECESSARY FOR THE
    6  DEVELOPMENT AND IMPROVEMENT OF STATE POLICIES AND PROGRAMS AFFECTING THE
    7  PROMOTION  OF  AMATEUR  SPORTING  EVENTS  AND  RELATED INDUSTRIES IN THE
    8  STATE.
    9    S 2. Reporting requirements. The chair of the New York state  advisory
   10  council  shall  report,  on  or  before March first next succeeding such
   11  council's initial convening and annually thereafter, to the governor and
   12  the legislature and make appropriate recommendations consistent with the
   13  purposes of this act.
   14    S 3. This act shall take effect immediately.
