STATE OF NEW YORK ________________________________________________________________________ 1898 2021-2022 Regular Sessions IN SENATE January 16, 2021 ___________ Introduced by Sens. AKSHAR, JORDAN -- read twice and ordered printed, and when printed to be committed to the Committee on Finance AN ACT to amend the executive law, in relation to minority and women- owned business enterprises in state contracts The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Section 313 of the executive law is amended by adding a new 2 subdivision 6-a to read as follows: 3 6-a. Notwithstanding the provisions of subdivision six of this 4 section, contracting agencies shall only require a contractor to comply 5 with the provisions of this section at a rate that correlates with the 6 percentage of certified minority and women-owned business enterprises in 7 that industry in the economic development region where the contract is 8 to be performed. Such percentage of certified minority and women-owned 9 business enterprises in each region, as such percentage applies to the 10 industries set forth in subdivision one of this section, shall be 11 published on the department of economic development's website with each 12 bid opportunity and shall be updated annually. 13 § 2. This act shall take effect immediately, provided, however, that 14 the amendment to article 15-A of the executive law made by section one 15 of this act shall not affect the expiration of such article and shall be 16 deemed to expire therewith.
