STATE OF NEW YORK ________________________________________________________________________ 1870 2021-2022 Regular Sessions IN SENATE January 16, 2021 ___________ Introduced by Sen. RITCHIE -- read twice and ordered printed, and when printed to be committed to the Committee on Local Government AN ACT authorizing the alienation of certain parklands in the town of Hastings, county of Oswego The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Notwithstanding section 2 of chapter 325 of the laws of 2 1920, subject to the provisions of this act, the town of Hastings, in 3 the county of Oswego, acting by and through its governing body and upon 4 such terms and conditions as determined by such body, is hereby author- 5 ized to discontinue as parklands and to sell pursuant to section 72-h of 6 the general municipal law, the lands described in section three of this 7 act, to the New York State Police Department for the purpose of provid- 8 ing necessary land for the construction of a New York State police 9 station. 10 § 2. The authorization contained in section one of this act shall take 11 effect only upon the condition that the town of Hastings shall dedicate 12 an amount equal to or greater than the fair market value of the park- 13 lands being discontinued towards the acquisition of new parklands and/or 14 capital improvements to existing park and recreational facilities. 15 § 3. The parklands authorized by section one of this act to be alien- 16 ated are described as follows: All that tract or parcel of land situate 17 in The Town of Hastings, County of Oswego and State of New York, being 18 part of Lot No. 28 and being part of Lot No. 29 in Township No. 13 of 19 Scriba's Patent, and being part of the lands conveyed from F. Don Sweet 20 to the Town of Hastings by deed dated April 16, 1969 and recorded at the 21 Oswego County Clerk's Office on April 16, 1969 in Book of Deeds 712 at 22 Page 116 and being more particularly described as follows: 23 Beginning at the southwesterly corner of lands of The Town of Hastings 24 (712/116), being a point on the southerly bounds of Lot No. 28, also 25 being the centerline of Wilson Road per deed (712/116), said point being EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. LBD04541-01-1S. 1870 2 1 easterly a distance of 645 feet, more or less, from the nominal center- 2 line intersection of Wilson Road and U. S. Route No. 11; 3 Thence running N. 28° 53' 09" E. along the easterly bounds of The Town 4 of Hastings (712/141) a distance of 435.60 feet to a point; thence S. 5 61° 57' 15" E. a distance of 300.00 feet to a point; thence S. 28° 53' 6 09" W. a distance of 435.60 feet to the southerly bounds of Lot No. 29; 7 thence N. 61° 57' 15" W. a distance of 300.00 feet to the point and 8 place of beginning containing 3.0 acres of land, more or less. 9 Subject to any and all easements and restrictions of record and the 10 highway rights of the public and the Town of Hastings in and to the 11 portion of Wilson Road lying within the bounds of the above described 12 parcel. 13 § 4. If the parkland that is described in section three of this act 14 has received funding pursuant to the federal land and water conservation 15 fund, the discontinuance of parklands authorized by section one of this 16 act shall not occur until the town of Hastings has complied with the 17 federal requirements pertaining to the conversion of parklands, includ- 18 ing satisfying the secretary of the interior that the discontinuance 19 with all conditions which the secretary of the interior deems necessary 20 to assure the substitution of other lands shall be equivalent in fair 21 market value and recreational usefulness to the lands being discontin- 22 ued. 23 § 5. This act shall take effect immediately.
