       AN ACT to amend the education law, in relation to authorizing polysomno-
         graphic technology services
         THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section  1.  Section  8505 of the education law is amended by adding a
    2  new subdivision 5 to read as follows:
    3     5.  THE PROVISION OF POLYSOMNOGRAPHIC TECHNOLOGY SERVICES, AS DEFINED
    4  BY THE COMMISSIONER, BY AN INDIVIDUAL, UNDER THE  DIRECTION  AND  SUPER-
    5  VISION OF A LICENSED PHYSICIAN, WHO HAS OBTAINED AUTHORIZATION ISSUED BY
    6  THE  DEPARTMENT.  SUCH  AUTHORIZATION SHALL BE ISSUED TO INDIVIDUALS WHO
    7  HAVE MET STANDARDS, INCLUDING THOSE RELATING TO  EDUCATION,  EXPERIENCE,
    8  EXAMINATION  AND CHARACTER, AS PROMULGATED IN REGULATIONS OF THE COMMIS-
    9  SIONER. SUCH AUTHORIZATION SHALL BE SUBJECT TO THE FULL DISCIPLINARY AND
   10  REGULATORY AUTHORITY OF THE BOARD OF REGENTS AND THE DEPARTMENT,  PURSU-
   11  ANT  TO THIS TITLE, AS IF SUCH AUTHORIZATION WERE A PROFESSIONAL LICENSE
   12  ISSUED UNDER THIS ARTICLE. THE APPLICATION FEE  FOR  SUCH  AUTHORIZATION
   13  SHALL BE THREE HUNDRED DOLLARS. EACH AUTHORIZATION HOLDER SHALL REGISTER
   14  WITH  THE  DEPARTMENT EVERY THREE YEARS AND SHALL PAY A REGISTRATION FEE
   15  OF THREE HUNDRED DOLLARS.
   16    S 2. This act shall take effect one year after it shall have become  a
   17  law.
