STATE OF NEW YORK ________________________________________________________________________ 1251 2017-2018 Regular Sessions IN SENATE January 6, 2017 ___________ Introduced by Sen. AKSHAR -- read twice and ordered printed, and when printed to be committed to the Committee on Local Government AN ACT to amend chapter 58 of the laws of 2005, relating to authorizing reimbursements for expenditures made by or on behalf of social services districts for medical assistance for needy persons and the administration thereof; and to amend the general municipal law, in relation to calculating social services district medical assistance expenditure amounts The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Section 1 of part C of chapter 58 of the laws of 2005, 2 relating to authorizing reimbursements for expenditures made by or on 3 behalf of social services districts for medical assistance for needy 4 persons and the administration thereof, is amended by adding a new 5 subdivision (c-2) to read as follows: 6 (c-2) Notwithstanding any provisions of subdivisions (c) and (c-1) of 7 this section to the contrary, effective April 1, 2017, for the period 8 January 1, 2017 through December 31, 2017 and for each calendar year 9 thereafter, the medical assistance expenditure amount for the social 10 services district for such period shall be the greater of (i) zero; or 11 (ii) the previous calendar year's medical assistance expenditure amount 12 minus 20% of the medical assistance expenditure amount for the period 13 January 1, 2016 through December 31, 2017, except that for the period 14 January 1, 2017 through December 31, 2017, the previous calendar year 15 medical assistance expenditure amount will be unchanged. The provisions 16 of this subdivision shall not apply to any social services district 17 containing a city having a population of one million or more. 18 § 2. Paragraph (c) of subdivision 3 of section 3-c of the general 19 municipal law is amended by adding a new subparagraph (viii) to read as 20 follows: EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. LBD04354-01-7S. 1251 2 1 (viii) Subtract the amount that the prior fiscal year's medical 2 assistance expenditure amount exceeds the current fiscal year's medical 3 assistance expenditure amount, provided that this shall only apply to 4 counties and shall only apply to fiscal years that begin after two thou- 5 sand seventeen. 6 § 3. This act shall take effect immediately, provided, however, that 7 the amendments to section 3-c of the general municipal law made by 8 section two of this act shall not affect the repeal of such section and 9 shall be deemed repealed therewith.
