       Introduced  by  Sen.  KRUGER -- read twice and ordered printed, and when
         printed to be committed to the Committee on Education
       AN ACT to amend the education law, in  relation  to  requiring  adequate
         training  in  the  Heimlich maneuver and cardiopulmonary resuscitation
         (CPR) for new certification as a school teacher
         THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section  1.  Section  3004 of the education law is amended by adding a
    2  new subdivision 7 to read as follows:
    3    7. NOTWITHSTANDING ANY OTHER PROVISION OF LAW, THE COMMISSIONER  SHALL
    4  PRESCRIBE  REGULATIONS  REQUIRING THAT ALL PERSONS APPLYING, ON OR AFTER
    5  JULY FIRST, TWO THOUSAND NINE, FOR A CERTIFICATE  OR  LICENSE  TO  BE  A
    6  TEACHER  SHALL,  IN ADDITION TO ALL THE OTHER CERTIFICATION OR LICENSURE
    7  REQUIREMENTS, HAVE COMPLETED ADEQUATE TRAINING IN THE HEIMLICH  MANEUVER
    8  AND  CARDIOPULMONARY RESUSCITATION (CPR). THE TRAINING SHALL BE OBTAINED
    9  FROM AN INSTITUTION OR PROVIDER WHICH HAS BEEN APPROVED BY  THE  DEPART-
   10  MENT TO PROVIDE SUCH TRAINING.  EACH APPLICANT SHALL PROVIDE THE DEPART-
   11  MENT  WITH  DOCUMENTATION  SHOWING  THAT  HE  OR  SHE  HAS COMPLETED THE
   12  REQUIRED TRAINING.
   13    S 2. This act shall take effect immediately.
