        AN  ACT  to  establish a temporary state commission to study child abuse
          and  neglect  prevention;  and  providing  for  the  repeal  of   such
          provisions upon expiration thereof
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
     1    Section 1. A temporary state commission on  child  abuse  and  neglect
     2  prevention is hereby established to examine, evaluate and make recommen-
     3  dations  concerning  child  abuse  and neglect prevention efforts in the
     4  state with the goal of preventing child removals, lowering  foster  care
     5  placements and increasing family reunification.
     6    §  2.  The  commission  shall  consist  of nine members, with adequate
     7  geographic representation, to be appointed as follows: three members  to
     8  be  appointed  by  the  governor;  three  members to be appointed by the
     9  temporary president of the senate; and three members to be appointed  by
    10  the speaker of the assembly. The members shall have demonstrated experi-
    11  ence  and  expertise in the field of child abuse and neglect prevention.
    12  The members of the commission shall receive no  compensation  for  their
    13  services,  but  shall  be  reimbursed  for  their  actual  and necessary
    14  expenses incurred in the performance of their duties under this act.
    15    § 3. The commission shall meet and may hold public hearings,  and  may
    16  undertake  any studies, inquiries, surveys or analyses it deems relevant
    17  in cooperation with or by agreement with any  other  public  or  private
    18  agency.

     1    §  4.  The  commission  shall focus on issues related to improving the
     2  delivery of prevention programs statewide, including but not limited  to
     3  an examination of the following:
     4    (a)  best  practices  that  have demonstrated outcomes in lowering the
     5  rate of child abuse and neglect;
     6    (b) best practices for identifying and engaging families  successfully
     7  in prevention programs;
     8    (c) the availability of quality prevention programs statewide, includ-
     9  ing the identification of regions where such programs are lacking;
    10    (d)  the  availability  and  adequacy  of  state funds for prevention,
    11  including where those  funds  are  allocated  and  how  they  are  being
    12  utilized; and
    13    (e)  the  extent  to which local social services districts are funding
    14  prevention programs on a regional basis, and  identification  of  imped-
    15  iments to local funding.
    16    §  5. The commission shall make a report of its findings to the gover-
    17  nor, the temporary president of the senate and the speaker of the assem-
    18  bly no later than one year after the effective date of  this  act.  Such
    19  report shall include any recommendations for any regulatory or statutory
    20  changes, or changes in funding for prevention programs.
    21    §  6.  This  act shall take effect immediately and shall expire and be
    22  deemed repealed two years after such effective date.
