        AN  ACT to amend the executive law, in relation to including Brantingham
          Lake, Delta Lake, Hinckley Reservoir, Oriskany Creek and  West  Canada
          Creek in the definition of Inland waterways
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
     1    Section 1. Subdivision 4 of section 911 of the executive law, as sepa-
     2  rately amended by chapters 43 and 255 of the laws of 2017, paragraph (a)
     3  as separately amended by chapter 433 of the laws of 2017, paragraph  (b)
     4  as  separately amended by chapter 142 of the laws of 2017, and paragraph
     5  (c) as separately amended by chapters 110, 142 and 161 of  the  laws  of
     6  2017, is amended to read as follows:
     7    4.  "Inland  waterways"  shall mean (a) the state's major inland lakes
     8  consisting of lakes Baldwin, Ballston, Big Tupper,  Black,  Brantingham,
     9  Campfire,  Canadarago, Canandaigua, Cayuga, Champlain, Charles, Chateau-
    10  gay, Chautauqua, Conesus, Cranberry, Delta, East Caroga,  Echo  (in  the
    11  county  of  Westchester),  George,  Glencoma,  Great Sacandaga, Hinckley
    12  Reservoir, Honeoye, Indian, Keuka, Little Wolf (in the county of  Frank-
    13  lin), Lincolndale, Long, Lost (in the county of Putnam), Mirror, MacGre-
    14  gor,  Mahopac, Northville, Oneida, Onondaga, Ossi, Otisco, Otsego, Owas-
    15  co, Peach, Placid,  Purdys,  Putnam,  Raquette,  Ronkonkoma,  Sacandaga,
    16  Saratoga, Schroon, Secor, Seneca, Shenorock, Skaneateles, Silver (in the
    17  county  of  Wyoming),  Saranac and Tonetta, Teakettle Spout, West Caroga
    18  and Wixon, Simon (in the county of Franklin) and  the  Fulton  chain  of
    19  lakes; (b) the state's major rivers comprised of the Allegheny, Ausable,
    20  Battenkill, Black, Boquet, Bronx, Canisteo, Chaumont (including Chaumont
    21  bay),  Chemung,  Chenango,  Cohocton,  Delaware,  Deer, Genesee, Grasse,
    22  Great Chazy, Hoosic, Hudson north of the federal dam  at  Troy,  Indian,
    23  Little  (in the Adirondack park), Little Ausable, Little Salmon (includ-
    24  ing north and  south  branches),  Mad,  Mettowee,  Mohawk,  Oswegatchie,
    25  Pocantico,  Racquette,  Sacandaga,  Salmon,  Saranac, Saw Mill, Schroon,
    26  Susquehanna, Tenmile, Tioga, Tioughnioga, Wallkill and  Buffalo  rivers,
    27  and  the  north  and middle branches of the Moose river; (c) the state's
         EXPLANATION--Matter in italics (underscored) is new; matter in brackets
                              [ ] is old law to be omitted.

     1  major creeks comprised of the 18 Mile Creek located in Erie county, Bash
     2  Bish and Kinderhook Creek located in Columbia county,  Kinderhook  Creek
     3  located  in Rensselaer county, Basher Kill, Bushkill, Cattaraugus, Caya-
     4  dutta,  Cincinnati, East Kill, Esopus (including upper and lower branch-
     5  es), Fish (including east and  west  branches),  Gooseberry,  Kennyetto,
     6  Little  Sandy, Onondaga, Peekskill Hollow, Roeliff Jansen Kill, Rondout,
     7  Sandy, Schoharie, Shawangunk Kill, South Sandy, Oatka,  Tonawanda,  West
     8  Kill,  Scajaquada,  Wappinger, Webatuck, Wassaic, Black Creek located in
     9  Monroe county, Black Creek located  in  Genesee  and  Wyoming  counties,
    10  Ellicott  Creek located in Erie county and Wynantskill, Claverack, Tagh-
    11  kanic [and], Agawamuck [and], Wyomanock, Oriskany, and West Canada;  (d)
    12  the  Barge  Canal System as defined in section two of the canal law; and
    13  (e) the adjacent shorelands to the extent that such  inland  waters  and
    14  adjacent  lands are strongly influenced by each other including, but not
    15  limited to, islands, wetlands, beaches, dunes, barrier islands,  cliffs,
    16  bluffs and erosion prone areas.
    17    § 2. This act shall take effect immediately.
