        AN ACT in relation to authorizing the town of Webster, county of  Monroe
          to alienate and convey certain parcels of land used as parklands
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
     1    Section 1. Subject to the provisions of this act, the town of Webster,
     2  county of Monroe, acting by and through its governing  body,  is  hereby
     3  authorized  to  discontinue  as  parklands  and  alienate the lands more
     4  particularly described in section three of this act,  and  to  sell  and
     5  convey  such  lands  at  fair market value to the Webster Central School
     6  District, county of Monroe, for the purposes of extending  the  school's
     7  sports and recreational fields.
     8    § 2. The authorization contained in section one of this act shall take
     9  effect  only  upon  the  condition  that  the town of Webster, county of
    10  Monroe, shall acquire and dedicate an amount equal to  or  greater  than
    11  the  fair  market  value of the parklands being discontinued towards the
    12  acquisition of new parklands or towards capital improvements to existing
    13  parkland and recreational facilities.
    14    § 3. The parkland to be alienated, commonly known as "Town of  Webster
    15  Park Parcel", consists of a total of 6.695 acres and is more particular-
    16  ly described as follows:
    17    THAT TRACT OR PARCEL OF LAND situate in the Town of Webster, County of
    18  Monroe and State of New York, bounded and described as follows: COMMENC-
    19  ING  at  the  centerline  intersection of Boulter Industrial Parkway and
    20  Basket Road-County Road 4; thence S88°23'29"W, along the  centerline  of
    21  said  Boulter  Industrial Parkway, a distance of 913.00 feet to a point;
    22  thence  S01°36'31"E,  a  distance  of  30.00  feet  to  a  point;   then
    23  S88°23'29"W,  a  distance of 25.00 feet to a point; thence along a curve
    24  to the left, having a delta angle of 51°57'22", a radius of 170.00 feet,
    25  and an arc length of 154.16 feet, said curve  also  having  a  chord  of
    26  S62°24'57"W  148.93  feet to a point; thence along a curve to the right,
    27  having a delta angle of 52"28'47", a radius of 330.00 feet  and  an  arc
    28  length  of  302.26  feet,  said curve also having a chord of S63°06'47"W
         EXPLANATION--Matter in italics (underscored) is new; matter in brackets

     1  291.81 feet to a point; thence S89°20'59"W, a distance of 429.52 feet to
     2  the point and place of beginning; thence  continuing  S89°20'59"W  along
     3  the  aforesaid  line,  a  distance  of  450.21  feet  to a point; thence
     4  N01°59'12"W, a distance of 637.43 feet to a point; thence N89°20"59"E, a
     5  distance  of  465.07  feet to a point; thence S00"39'02"E, a distance of
     6  637.25 feet to the point and place of beginning.
     7    § 4. In the event that the fair market value of the parklands acquired
     8  and dedicated as replacement parklands in accordance with the provisions
     9  of section two of this act, are not equal to or greater  than  the  fair
    10  market  value  of  the parklands to be alienated as described in section
    11  three of this act, the town of Webster shall dedicate the difference  of
    12  the  fair  market value of the lands to be alienated and the lands to be
    13  dedicated  for  the  acquisition  of  additional  parklands  or  capital
    14  improvements to existing park and recreational facilities.
    15    §  5.  In  the  event  that  the  town of Webster received any funding
    16  support or assistance from the  federal  government  for  the  purchase,
    17  maintenance  or  improvement of the parklands set forth in section three
    18  of this act, the discontinuance of parkland authorized by the provisions
    19  of this act shall not occur until the town of Webster has complied  with
    20  any  federal  requirements pertaining to the alienation or conversion of
    21  such parklands, including satisfying the secretary of the interior  that
    22  the  alienation  or  conversion  complies  with all conditions which the
    23  secretary of the interior deems necessary to assure the substitution  of
    24  other  lands  shall  be equivalent in fair market value and recreational
    25  usefulness to the lands being alienated or converted.
    26    § 6. This act shall take effect immediately.
