STATE OF NEW YORK ________________________________________________________________________ 11064 IN ASSEMBLY October 7, 2020 ___________ Introduced by COMMITTEE ON RULES -- (at request of M. of A. Simon) -- read once and referred to the Committee on Labor AN ACT to amend the labor law, in relation to providing that compen- sation earned for training and serving as a poll worker during the 2020 general election shall not be the sole basis for any reduction in current or future unemployment benefits payable The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Section 591 of the labor law is amended by adding a new 2 subdivision 1-a to read as follows: 3 1-a. Notwithstanding the provisions of subdivision one of this 4 section, a claimant who is qualified for benefits and certified in 5 accordance with the provisions of this article shall not be denied full 6 benefits payable pursuant to this article solely because such claimant 7 was compensated for service or training as a poll worker for the two 8 thousand twenty general election during the period of declared emergency 9 under Executive Order 202 of 2020 and any extension thereof. Such 10 compensation shall not be the basis for any reduction in benefits calcu- 11 lated for any week that the claimant worked or trained as a poll worker 12 and shall not be the basis for any reduction in the calculation of 13 future benefits during the pendency of the declared emergency under 14 Executive Order 202 of 2020 and any extension thereof, including addi- 15 tional federally-mandated pandemic unemployment assistance benefits 16 related to the coronavirus pandemic (COVID-19). 17 § 2.
