STATE OF NEW YORK ________________________________________________________________________ 10876 IN ASSEMBLY May 25, 2018 ___________ Introduced by M. of A. BRABENEC -- read once and referred to the Commit- tee on Real Property Taxation AN ACT in relation to permitting Hamaspik of Orange County, Inc. to file an application for a certain real property tax exemption The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Notwithstanding any other provision of law to the contrary, 2 the assessor of the village of Kiryas Joel, county of Orange, is hereby 3 authorized to accept from Hamaspik of Orange County, Inc. an application 4 for exemption from real property taxes pursuant to section 420-a of the 5 real property tax law for the 2017 assessment roll with respect to the 6 2017-2018 school taxes and the 2018 county and town taxes for the 7 parcels conveyed to such not-for-profit organization located at East 8 Bakertown Road, otherwise known as tax map reference numbers 9 310-1-12.12, 310-1-15, and 310-1-16. If accepted, the application shall 10 be reviewed as if it had been received on or before the taxable status 11 date established for such roll. If satisfied that such not-for-profit 12 organization would otherwise be entitled to such exemption if such not- 13 for-profit organization had filed an application for exemption by the 14 appropriate taxable status date, the assessor, upon approval by the 15 Kiryas Joel village trustees, may make appropriate correction to the 16 subject roll. If such exemption is granted and such not-for-profit 17 organization, therefore, shall have paid any taxes with respect to the 18 subject roll, the applicable governing body or tax department may, in 19 its sole discretion, provide for the refund of those taxes paid and 20 cancel those taxes, fines, penalties, liens, or interest remaining 21 unpaid. 22 § 2.
