       AN ACT to amend the public health law, in relation to reimbursement  for
         aerial spraying for mosquitoes on state land
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. Section 621 of the public health law, as amended by section
    2  5 of part A of chapter 58 of the laws of 2008, is  amended  to  read  as
    3  follows:
    4    S 621. State aid; public health emergencies. If the state commissioner
    5  or  a  county  health  department or part-county department of health or
    6  municipality, with the approval of the  state  commissioner,  determines
    7  that  there is an imminent threat to public health, the department shall
    8  reimburse counties or municipalities at fifty per centum for the cost of
    9  emergency measures as approved by the  department  and  subject  to  the
   10  approval  of the director of the budget, EXCEPT THAT AERIAL SPRAYING FOR
   11  MOSQUITOES ON STATE LAND SHALL BE REIMBURSED AT ONE HUNDRED PER  CENTUM,
   12  WITHIN  AMOUNTS  APPROPRIATED.   Such funds shall be made available from
   13  funds appropriated for public health emergencies, only to those counties
   14  or municipalities, which have expended all other state aid which may  be
   15  available   for  related  activities  and  have  developed  measures  to
   16  adequately address the  emergency.  Reimbursement  is  conditioned  upon
   17  availability of appropriated funds. For purposes of this section, "muni-
   18  cipality"  means  a health department of a city that is not located in a
   19  county or part-county health district or a county in which the  legisla-
   20  ture has the powers and duties of a board of health of a county or part-
   21  county  health district and cities with a population of over one million
   22  persons.
   23    S 2. This act shall take effect immediately.
