       AN ACT to authorize the commissioner of general services to transfer and
         convey  certain unappropriated state land to the Hoosick Area Partner-
         ship for Parents and Youth for community programs
         THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section  1.  Subject to the provisions of this act but notwithstanding
    2  any other provision of law to the contrary, the commissioner of  general
    3  services is hereby authorized to transfer and convey to the Hoosick Area
    4  Partnership  for  Parents  and  Youth,  a 501(c)(3) charitable community
    5  development corporation, the state land located  at  80  Church  Street,
    6  village  of  Hoosick  Falls,  in  the county of Rensselaer, known as the
    7  Hoosick Falls Armory, declared to be abandoned state land by  the  divi-
    8  sion  of  military and naval affairs. The transfer and conveyance of the
    9  land described in section two of this act shall be made at such time and
   10  upon such terms and conditions as the commissioner of  general  services
   11  may fix and determine.
   12    S 2. The lands authorized by section one of this act to be transferred
   13  and conveyed are as follows:
   14    ALL  that  tract  or parcel of land known as the Hoosick Falls Armory,
   15  situate, lying and being in the Village and Town of Hoosick Falls, Coun-
   16  ty of Rensselaer, State of New York, bounded and described as follows:
   17    BEGINNING at a point on the southerly boundary line of Elm Street,  at
   18  the  intersection of the division line between the lands, now or former-
   19  ly, of the Immaculate Conception Church of Hoosick Falls on the east and
   20  the New York State "Armory Lot" on the west; thence along said  division
   21  line  South 7  45' West, 94 feet, more or less, to a point on the north-
   22  erly boundary line of lands, now or formerly, of Cleveland E. Dodge Jr.;
   23  thence along said boundary line North 86  15' West, 109  feet,  more  or
   24  less, and North 86  15' West, 49.5 feet, more or less, to a point on the
   25  easterly  boundary  line  of  Church  Street; thence along said easterly
   26  boundary line of Church Street North 13  15'  East,  26  feet,  more  or
   27  less, and North 13  15' East, 52 feet, more or less, to the southeaster-

    1  ly  boundary line of lands of the People of the State of New York trans-
    2  ferred to the New York State Department of Transportation  by  Order  of
    3  the Commissioner of General Services dated October 20, 2005 and shown on
    4  Map No. 25-T, Parcel No.  25, filed in the Office of General Services as
    5  O.G.S.  Map  No.  2048; thence along said southeasterly boundary line 17
    6  feet, more or less, to the southerly boundary line of Elm Street; thence
    7  along the southerly boundary line of Elm Street the following three  (3)
    8  courses and distances:
    9    1. North 67  30' East, 8 feet, more or less;
   10    2. North 70  30' East, 18 feet, more or less; and
   11    3.  South 84  00' East, 119 feet, more or less, to the point and place
   12  of beginning.
   13    BEING the same premises acquired by the People of  the  State  of  New
   14  York for the Hoosick Falls Armory by the following deeds:
   15    1.  Deed  from  Charles  Q.  Eldredge,  et. ux., dated June 7,1888 and
   16  recorded in the Rensselaer County Clerk's Office in Liber 223  of  Deeds
   17  at page 471;
   18    2.  Deed  from  Gaylord  B.  White,  et.  al.,  dated July 1, 1892 and
   19  recorded in the Rensselaer County Clerk's Office in Liber 242  of  Deeds
   20  at page 318;
   21    3.  Deed  from  Lucy  E. White, dated July 1, 1892 and recorded in the
   22  Rensselaer County Clerk's Office in Liber 242 of Deeds at page 319;
   23    4. Deed from Elizabeth Robinson, dated July 1, 1892  and  recorded  in
   24  the  Rensselaer County Clerk's Office in Liber 242 of Deeds at page 320;
   25  and
   26    5. Deed from Charles Q. Eldredge, et. ux.,  dated  June  1,  1893  and
   27  recorded  in  the Rensselaer County Clerk's Office in Liber 242 of Deeds
   28  at page 321.
   29    EXCEPTING lands transferred to the New York State Department of Trans-
   30  portation by Order of the Commissioner of General Services dated October
   31  20, 2005 and shown on Map No. 25-T, Parcel No. 25, filed in  the  Office
   32  of General Services as O.G.S. Map No. 2048.
   33    ALSO  EXCEPTING the rights, if any, of the Village of Hoosick Falls in
   34  and to that portion of the bed of Elm Street which is lying  within  the
   35  above described premises.
   36    S  3. The description in section two of this act is not intended to be
   37  a legal description but  is  intended  to  identify  the  parcel  to  be
   38  conveyed.   As a condition of the transfer, Hoosick Area Partnership for
   39  Parents and Youth may submit to the commissioner  of  general  services,
   40  for his or her approval, an accurate survey and description of the lands
   41  to be conveyed, which may be used in the conveyance thereof.
   42    S  4.  The office of general services shall not transfer or convey the
   43  aforesaid land unless application is  made  to  the  office  of  general
   44  services  by the Hoosick Area Partnership for Parents and Youth within 1
   45  year after the effective date of this act. Said application shall be  in
   46  the  form  of  a  resolution  setting  forth  a  comprehensive statement
   47  approved by its managing  board  acknowledging  and  accepting  the  use
   48  restrictions set forth in section five of this act.
   49    S  5.  The  transfer and conveyance made pursuant to this act shall be
   50  subject to the following use restrictions and reverter:
   51    (a) The land described in this act shall be used exclusively  for  the
   52  purposes  of  housing  various  community  programs  including  programs
   53  pertaining to education, recreation, health and wellness, civic  groups,
   54  cultural  and  youth  associations,  veterans affairs, public safety and
   55  historic preservation.

    1    (b) The conveyance of the land described in this act shall  contain  a
    2  covenant  and  restriction  requiring  that  the  land  be  used for the
    3  purposes set forth in subdivision (a) of this section. In the event  the
    4  premises are not accepted and/or used for such purposes, it shall revert
    5  to the state of New York.
    6    S 6. This act shall take effect immediately.
