AN ACT to authorize the commissioner of general services to transfer and
convey certain unappropriated state land to the Hoosick Area Partner-
ship for Parents and Youth for community programs
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:
1 Section 1. Subject to the provisions of this act but notwithstanding
2 any other provision of law to the contrary, the commissioner of general
3 services is hereby authorized to transfer and convey to the Hoosick Area
4 Partnership for Parents and Youth, a 501(c)(3) charitable community
5 development corporation, the state land located at 80 Church Street,
6 village of Hoosick Falls, in the county of Rensselaer, known as the
7 Hoosick Falls Armory, declared to be abandoned state land by the divi-
8 sion of military and naval affairs. The transfer and conveyance of the
9 land described in section two of this act shall be made in consideration
10 of the sum of one dollar and upon such conditions as the commissioner of
11 general services may deem proper.
12 S 2. The lands authorized by section one of this act to be transferred
13 and conveyed are as follows:
14 ALL that tract or parcel of land known as the Hoosick Falls Armory,
15 situate, lying and being in the Village and Town of Hoosick Falls, Coun-
16 ty of Rensselaer, State of New York, bounded and described as follows:
17 BEGINNING at a point on the southerly boundary line of Elm Street, at
18 the intersection of the division line between the lands, now or former-
19 ly, of the Immaculate Conception Church of Hoosick Falls on the east and
20 the New York State "Armory Lot" on the west; thence along said division
21 line South 7 45' West, 94 feet, more or less, to a point on the north-
22 erly boundary line of lands, now or formerly, of Cleveland E. Dodge Jr.;
23 thence along said boundary line North 86 15' West, 109 feet, more or
24 less, and North 86 15' West, 49.5 feet, more or less, to a point on the
25 easterly boundary line of Church Street; thence along said easterly
26 boundary line of Church Street North 13 15' East, 26 feet, more or

1 less, and North 13 15' East, 52 feet, more or less, to the southeaster-
2 ly boundary line of lands of the People of the State of New York trans-
3 ferred to the New York State Department of Transportation by Order of
4 the Commissioner of General Services dated October 20, 2005 and shown on
5 Map No. 25-T, Parcel No. 25, filed in the Office of General Services as
6 O.G.S. Map No. 2048; thence along said southeasterly boundary line 17
7 feet, more or less, to the southerly boundary line of Elm Street; thence
8 along the southerly boundary line of Elm Street the following three (3)
9 courses and distances:
10 1. North 67 30' East, 8 feet, more or less;
11 2. North 70 30' East, 18 feet, more or less; and
12 3. South 84 00' East, 119 feet, more or less, to the point and place
13 of beginning.
14 BEING the same premises acquired by the People of the State of New
15 York for the Hoosick Falls Armory by the following deeds:
16 1. Deed from Charles Q. Eldredge, et. ux., dated June 7,1888 and
17 recorded in the Rensselaer County Clerk's Office in Liber 223 of Deeds
18 at page 471;
19 2. Deed from Gaylord B. White, et. al., dated July 1, 1892 and
20 recorded in the Rensselaer County Clerk's Office in Liber 242 of Deeds
21 at page 318;
22 3. Deed from Lucy E. White, dated July 1, 1892 and recorded in the
23 Rensselaer County Clerk's Office in Liber 242 of Deeds at page 319;
24 4. Deed from Elizabeth Robinson, dated July 1, 1892 and recorded in
25 the Rensselaer County Clerk's Office in Liber 242 of Deeds at page 320;
26 and
27 5. Deed from Charles Q. Eldredge, et. ux., dated June 1, 1893 and
28 recorded in the Rensselaer County Clerk's Office in Liber 242 of Deeds
29 at page 321.
30 EXCEPTING lands transferred to the New York State Department of Trans-
31 portation by Order of the Commissioner of General Services dated October
32 20, 2005 and shown on Map No. 25-T, Parcel No. 25, filed in the Office
33 of General Services as O.G.S. Map No. 2048.
34 ALSO EXCEPTING the rights, if any, of the Village of Hoosick Falls in
35 and to that portion of the bed of Elm Street which is lying within the
36 above described premises.
37 S 3. The description in section two of this act is not intended to be
38 a legal description but is intended to identify the parcel to be
39 conveyed. As a condition of the transfer, Hoosick Area Partnership for
40 Parents and Youth may submit to the commissioner of general services,
41 for his or her approval, an accurate survey and description of the lands
42 to be conveyed, which may be used in the conveyance thereof.
43 S 4. The office of general services shall not transfer or convey the
44 aforesaid land unless application is made to the office of general
45 services by the Hoosick Area Partnership for Parents and Youth within 1
46 year after the effective date of this act. Said application shall be in
47 the form of a resolution setting forth a comprehensive statement
48 approved by its managing board acknowledging and accepting the use
49 restrictions set forth in section five of this act.
50 S 5. The transfer and conveyance made pursuant to this act shall be
51 subject to the following use restrictions and reverter:
52 (a) The land described in this act shall be used exclusively for the
53 purposes of housing various community programs including programs
54 pertaining to education, recreation, health and wellness, civic groups,
55 cultural and youth associations, veterans affairs, public safety and
56 historic preservation.

1 (b) The conveyance of the land described in this act shall contain a
2 covenant and restriction requiring that the land be used for the
3 purposes set forth in subdivision (a) of this section. In the event the
4 premises are not accepted and/or used for such purposes, it shall revert
5 to the state of New York.
6 S 6. This act shall take effect immediately.
