       AN ACT to amend the executive law, in relation to establishing fines for
         violations  of the uniform fire prevention and building code when such
         violation involves impeding egress from the building during a fire  or
         other emergency evacuation
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. Section 382 of the executive law is amended by adding a new
    2  subdivision 4 to read as follows:
    3    4. WHERE THE CONSTRUCTION OR USE OF A BUILDING IS IN VIOLATION OF  ANY
    4  PROVISION  OF  THE UNIFORM CODE OR ANY LAWFUL ORDER OBTAINED THEREUNDER,
    5  AND SUCH VIOLATION IMPEDES EGRESS FROM A BUILDING DURING A FIRE OR OTHER
    6  EMERGENCY EVACUATION, THE OWNER OF SUCH BUILDING SHALL BE SUBJECT  TO  A
    7  FINE  OF  NOT  LESS  THAN ONE THOUSAND DOLLARS OR MORE THAN TEN THOUSAND
    8  DOLLARS.
    9    S 2. This act shall take effect immediately.
