STATE OF NEW YORK ________________________________________________________________________ 10020 IN ASSEMBLY March 7, 2018 ___________ Introduced by M. of A. PAULIN -- read once and referred to the Committee on Governmental Operations AN ACT to amend the legislative law, in relation to establishing a committee on workplace rights and a workplace climate survey on discrimination and harassment The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Article 7 and sections 100 and 101 of the legislative law, 2 as renumbered by chapter 510 of the laws of 1999, are renumbered article 3 8 and sections 200 and 201 and a new article 7 is added to read as 4 follows: 5 ARTICLE 7 6 COMMITTEE ON WORKPLACE RIGHTS 7 Section 100. Committee on workplace rights established. 8 101. Workplace climate survey. 9 § 100. Committee on workplace rights established. 1. The committee on 10 workplace rights shall consist of four members to be appointed as 11 follows: one member shall be a representative of the senate majority 12 personnel office, appointed by the temporary president of the senate; 13 one member shall be a representative of the assembly human resources 14 department, appointed by the speaker of the assembly; one member shall 15 be a representative of the senate minority personnel office, appointed 16 by the minority leader of the senate; and one member shall be a repre- 17 sentative of the assembly minority administration and personnel office, 18 appointed by the minority leader of the assembly. Any vacancy that 19 occurs in the committee shall be filled in the same manner in which the 20 original appointment was made. 21 2. The committee shall not receive compensation, but shall be reim- 22 bursed for their necessary and actual expenses incurred in the perform- 23 ance of their duties in the work of the committee. 24 § 101. Workplace climate survey. 1. (a) The committee shall carry out 25 an anonymous survey of individuals serving in positions in the assembly 26 of the state of New York and in positions in the senate of the state of 27 New York to determine: EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. LBD15005-02-8A. 10020 2 1 i. the scope of discrimination and harassment in the state legisla- 2 ture; 3 ii. whether discrimination and harassment prevention and reform 4 efforts are working to curb the prevalence of discrimination and harass- 5 ment in the state legislature; and 6 iii. whether the complaint and reporting process regarding instances 7 of discrimination and harassment in the state legislature is sufficient. 8 (b) The survey shall be conducted no later than one year following the 9 establishment of the committee and every two years thereafter. 10 2. (a) The committee shall prepare a report regarding the findings of 11 the survey described in subdivision one of this section that does not 12 reveal the methods used by the committee to gather responses to the 13 survey. 14 (b) The committee shall submit the report only to the assembly commit- 15 tee on ethics and guidance, the assembly committee on rules, the senate 16 committee on ethics and internal governance, the senate committee on 17 rules, the temporary president of the senate, the speaker of the assem- 18 bly, the minority leader of the senate, and the minority leader of the 19 assembly. 20 § 2. This act shall take effect on the one hundred eightieth day after 21 it shall have become a law.
