STATE OF NEW YORK ________________________________________________________________________ 10004 IN ASSEMBLY May 1, 2024 ___________ Introduced by M. of A. STERN -- read once and referred to the Committee on Energy AN ACT to amend the executive law, in relation to requiring the office of renewable energy siting to develop a procedure to process any financial security or letter of credit required by the office The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Paragraph (g) of subdivision 3 of section 94-c of the exec- 2 utive law, as added by section 4 of part JJJ of chapter 58 of the laws 3 of 2020, is amended to read as follows: 4 (g) The office shall within one year of the effective date of this 5 section promulgate rules and regulations with respect to all necessary 6 requirements to implement the siting permit program established in this 7 section and promulgate modifications to such rules and regulations as it 8 deems necessary; provided that the office shall promulgate regulations 9 requiring the service of applications on affected municipalities and 10 political subdivisions simultaneously with submission of the application 11 to the office. The office shall develop a procedure to process any 12 financial security or letter of credit that is required by the office. 13 Such procedure shall be available to any municipality that decides to 14 have the office process and maintain any required financial security or 15 letter of credit in their permitting process. 16 § 2. This act shall take effect immediately; provided, however, that 17 the amendments to section 94-c of the executive law, made by section one 18 of this act, shall not affect the repeal of such section and shall be 19 deemed repealed therewith.
