BYRNE -- read once and referred to the Committee on Local Governments AN ACT to amend the town law and the public officers law, in relation to the residency requirement for the court attendant for the town of Somers, in the county of Westchester The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Section 23 of the town law is amended by adding a new 2 subdivision 32 to read as follows: 3 32. Notwithstanding subdivision one of this section, in the town of 4 Somers, in the county of Westchester, the provisions of this section 5 requiring a person to be a resident of the political subdivision or 6 municipal corporation of the state for which he or she shall be chosen 7 or within which his or her official functions are required to be exer- 8 cised, shall not prevent a person from holding the position of court 9 attendant for the town of Somers, provided that such person resides in 10 the county in which such town is located. Provided, however, the person 11 performing the functions of court attendant in any other town shall be a 12 resident of such town, unless otherwise provided by an act of the state 13 legislature. 14 § 2. Section 3 of the public officers law is amended by adding a new 15 subdivision 67 to read as follows: 16 67. In the town of Somers, in the county of Westchester, the 17 provisions of this section requiring a person to be a resident of the 18 political subdivision or municipal corporation of the state for which he 19 or she shall be chosen or within which his or her official functions are 20 required to be exercised shall not prevent a person from holding the 21 position of court attendant for the town of Somers, provided that such 22 person resides in the county in which such town is located. Provided, 23 however, the person performing the functions of court attendant in any 24 other town shall be a resident of such town, unless otherwise provided 25 by an act of the state legislature. 26 § 3.
