       AN ACT to amend the education law, in relation to resident undergraduate
         tuition for SUNY and CUNY; and to amend section 16 of chapter  260  of
         the  laws  of  2011  amending the education law and the New York state
         urban development corporation act, relating to establishing components
         of the NY-SUNY 2020 challenge grant program, in relation to the effec-
         tiveness thereof
         THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section  1.  Clauses  (i) and (ii) of subparagraph 4 of paragraph h of
    2  subdivision 2 of section 355 of the education law, clause (i) as amended
    3  by chapter 260 of the laws of 2011 and clause (ii) as amended by section
    4  1 of part P of chapter 57 of the laws of 2012, are amended  to  read  as
    5  follows:
    6    (i)  Commencing  with  the  two  thousand  eleven--two thousand twelve
    7  academic year and ending  in  the  two  thousand  fifteen--two  thousand
    8  sixteen academic year the state university of New York board of trustees
    9  shall  be  empowered  to  increase  the  resident  undergraduate rate of
   10  tuition by not more than three hundred dollars over the resident  under-
   11  graduate  rate  of tuition adopted by the board of trustees in the prior
   12  academic year, provided however that FOR THE  TWO  THOUSAND  ELEVEN--TWO
   13  THOUSAND  TWELVE  ACADEMIC  YEAR  AND  THEREAFTER if the annual resident
   14  undergraduate rate of tuition would exceed five thousand dollars, then a
   15  tuition credit for each eligible student, as determined  and  calculated
   16  by  the New York state higher education services corporation pursuant to
   17  section six hundred eighty-nine-a of this title, shall be applied toward
   18  the tuition charged for each semester, quarter or term of study. Tuition
   19  for each semester, quarter or term of study shall not  be  due  for  any
   20  student eligible to receive such tuition credit until the tuition credit

    1  is  calculated  and  applied  against the tuition charged for the corre-
    2  sponding semester, quarter or term.
    3    (ii)  On  or before November thirtieth, two thousand eleven, the trus-
    4  tees shall approve and submit to the chairs of  the  assembly  ways  and
    5  means  committee and the senate finance committee and to the director of
    6  the budget a master tuition plan setting forth the  tuition  rates  that
    7  the  trustees  propose  for resident undergraduate students for the five
    8  year period commencing with the two thousand eleven--two thousand twelve
    9  academic year and  ending  in  the  two  thousand  fifteen-two  thousand
   10  sixteen  academic year, and shall submit any proposed amendments to such
   11  plan by November thirtieth of each subsequent  year  thereafter  through
   12  November  thirtieth, two thousand fifteen, and provided further COMMENC-
   13  ING IN THE TWO THOUSAND ELEVEN--TWO THOUSAND TWELVE  ACADEMIC  YEAR  AND
   14  ENDING  IN THE TWO THOUSAND FIFTEEN--TWO THOUSAND SIXTEEN ACADEMIC YEAR,
   15  that with the approval of the board of trustees, each university  center
   16  may  increase  non-resident undergraduate tuition rates each year by not
   17  more than ten percent over the tuition rates of the prior academic  year
   18  for a five year period commencing with the semester following the semes-
   19  ter  in which the governor and the chancellor of the state university of
   20  New York approve the NY-SUNY 2020 proposal for such university center.
   21    S 2. Subparagraph (i) of paragraph (a) of  subdivision  7  of  section
   22  6206  of  the  education  law,  as amended by chapter 260 of the laws of
   23  2011, is amended to read as follows:
   24    (i) Commencing with  the  two  thousand  eleven--two  thousand  twelve
   25  academic  year  and  ending  in  the  two thousand fifteen--two thousand
   26  sixteen academic year, the city university of New York board of trustees
   27  shall be empowered  to  increase  the  resident  undergraduate  rate  of
   28  tuition  by not more than three hundred dollars over the resident under-
   29  graduate rate of tuition adopted by the board of trustees in  the  prior
   30  academic  year,  provided  however that FOR THE TWO THOUSAND ELEVEN--TWO
   31  THOUSAND TWELVE ACADEMIC YEAR AND  THEREAFTER  if  the  annual  resident
   32  undergraduate rate of tuition would exceed five thousand dollars, then a
   33  tuition  credit  for each eligible student, as determined and calculated
   34  by the New York state higher education services corporation pursuant  to
   35  section  six  hundred  eighty-nine-a  of  this chapter, shall be applied
   36  toward the tuition charged for each semester, quarter or term of  study.
   37  Tuition for each semester, quarter or term of study shall not be due for
   38  any  student  eligible  to receive such tuition credit until the tuition
   39  credit is calculated and applied against the  tuition  charged  for  the
   40  corresponding semester, quarter or term.
   41    S 3. Section 16 of chapter 260 of the laws of 2011 amending the educa-
   42  tion  law  and  the  New  York  state urban development corporation act,
   43  relating to establishing components of the NY-SUNY 2020 challenge  grant
   44  program, as amended by section 65-a of part HH of chapter 57 of the laws
   45  of 2013, is amended to read as follows:
   46    S  16. This act shall take effect July 1, 2011; provided that sections
   47  one, two, [three, four, five,] six, eight, nine,  ten,  eleven,  twelve,
   48  thirteen,  fourteen  and  fifteen of this act shall expire 5 years after
   49  such effective date when upon such date the provisions of this act shall
   50  be deemed repealed.
   51    S 4. This act shall take effect immediately.
