        AN ACT to amend the criminal procedure law and  the  education  law,  in
          relation  to granting police officer status to university campus peace
          officers employed by the city university of New York;  and  to  repeal
          certain provisions of the criminal procedure law relating thereto

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:

     1    Section 1. Subdivision 34 of section 1.20 of  the  criminal  procedure
     2  law is amended by adding a new paragraph (w) to read as follows:
     3    (w)  A campus police officer appointed by the city university pursuant
     4  to subdivision sixteen of section six thousand two hundred  six  of  the
     5  education  law,  who  shall  have their powers set forth in this section
     6  whether or not they are acting pursuant to their official duties.
     7    § 2. Paragraph (a) of subdivision 34-a of section 1.20 of the criminal
     8  procedure law, as amended by chapter 428 of the laws of 1999, is amended
     9  and a new paragraph (f) is added to read as follows:
    10    (a) Except as provided in [paragraph] paragraphs (d) and (f)  of  this
    11  subdivision,  New  York  state  constitutes  the  "geographical  area of
    12  employment" of any police officer employed as such by an agency  of  the
    13  state  or  by  an  authority  which functions throughout the state, or a
    14  police officer designated by the superintendent of state police pursuant
    15  to section two hundred twenty-three of the executive law;
    16    (f) The geographical area of employment of a police officer  appointed
    17  by  the  city  university is the campuses and other property of the city
    18  university, including any portion of a public highway which  crosses  or
    19  abuts such property.
    20    § 3. Paragraph (a) of subdivision 34-a of section 1.20 of the criminal
    21  procedure law, as amended by chapter 424 of the laws of 1998, is amended
    22  to read as follows:
    23    (a)  Except  as provided in [paragraph] paragraphs (d) and (f) of this
    24  subdivision, New  York  state  constitutes  the  "geographical  area  of
    25  employment"  of  any police officer employed as such by an agency of the
    26  state or by an authority which functions throughout the state;

     1    § 4. Subdivision 79 of section 2.10 of the criminal procedure law,  as
     2  added by chapter 664 of the laws of 2004, is REPEALED.
     3    §  5.  Subdivision 16 of section 6206 of the education law, as amended
     4  by chapter 230 of the laws of 2005, is amended to read as follows:
     5    16. [The board of trustees] The city university shall appoint for  the
     6  city  university  campus  officers  who shall have the powers of [peace]
     7  police officers as set forth in the criminal procedure  law  within  the
     8  geographical  area  of the city of New York. A campus officer designated
     9  as a [peace]  police  officer  must  have  satisfactorily  completed  or
    10  complete,  within  one year of the date of such designation, a course of
    11  law enforcement training prescribed by  the  municipal  police  training
    12  council  in  consultation  with the city university [board of trustees].
    13  It shall be the duty of such police officers to preserve law  and  order
    14  on the campuses and other property of the city university, including any
    15  portion of a public highway which crosses or abuts such property.
    16    §  6. This act shall take effect immediately; provided that the amend-
    17  ments to paragraph (a) of subdivision 34-a of section 1.20 of the crimi-
    18  nal procedure law as made by section two of this act shall be subject to
    19  the expiration and reversion of such paragraph pursuant to section three
    20  of chapter 428 of the laws of 1999, as amended, when upon such date  the
    21  provisions of section three of this act shall take effect.
