        AN ACT to  amend  the  agriculture  and  markets  law,  in  relation  to
          restricting  individuals  from  owning  a companion animal after being
          convicted of certain crimes involving animals

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:

     1    Section  1. The agriculture and markets law is amended by adding a new
     2  section 353-g to read as follows:
     3    § 353-g. Restrictions on  companion  animal  ownership.  1.  A  person
     4  convicted  of  violating  section three hundred fifty-one, three hundred
     5  fifty-three, or three hundred fifty-three-a of  this  article  shall  be
     6  prohibited  from  owning,  harboring, possessing, adopting, fostering or
     7  exercising control over a companion animal for a period of  time  to  be
     8  set  at  the discretion of the court. Such time period shall not be less
     9  than five years after such conviction or if applicable,  not  less  than
    10  five  years  after  the  convicted  person's  release from imprisonment,
    11  whichever is longer.
    12    2. For the purposes of this section "companion animal" shall have  the
    13  same  meaning as subdivision five of section three hundred fifty of this
    14  article.
    15    § 2. This act shall take effect on the ninetieth day  after  it  shall
    16  have become a law.
