STATE OF NEW YORK ________________________________________________________________________ 8611 2015-2016 Regular Sessions IN ASSEMBLY December 16, 2015 ___________ Introduced by M. of A. MILLER -- read once and referred to the Committee on Codes AN ACT to amend the penal law, in relation to assault on a library employee The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Subdivision 11 of section 120.05 of the penal law, as sepa- 2 rately amended by chapters 472 and 487 of the laws of 2015, is amended 3 to read as follows: 4 11. With intent to cause physical injury to a train operator, ticket 5 inspector, conductor, signalperson, bus operator or station agent 6 employed by any transit agency, authority or company, public or private, 7 whose operation is authorized by New York state or any of its political 8 subdivisions, a city marshal, a school crossing guard appointed pursuant 9 to section two hundred eight-a of the general municipal law, a traffic 10 enforcement officer, traffic enforcement agent, prosecutor as defined in 11 subdivision thirty-one of section 1.20 of the criminal procedure law, 12 sanitation enforcement agent, New York city sanitation worker, public 13 health sanitarian, New York city public health sanitarian, registered 14 nurse, licensed practical nurse, emergency medical service paramedic, 15 [or] emergency medical service technician or library employee, he or 16 she causes physical injury to such train operator, ticket inspector, 17 conductor, signalperson, bus operator or station agent, city marshal, 18 school crossing guard appointed pursuant to section two hundred eight-a 19 of the general municipal law, traffic enforcement officer, traffic 20 enforcement agent, prosecutor as defined in subdivision thirty-one of 21 section 1.20 of the criminal procedure law, registered nurse, licensed 22 practical nurse, public health sanitarian, New York city public health 23 sanitarian, sanitation enforcement agent, New York city sanitation work- 24 er, emergency medical service paramedic, [or] emergency medical service 25 technician or library employee, while such employee is performing an EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted.
