        AN ACT to amend the vehicle and traffic law, in relation to the use of a
          fireproof blanket, bag or container when charging a bicycle with elec-
          tric assist or an electric scooter

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:

     1    Section 1. The vehicle and traffic law is  amended  by  adding  a  new
     2  section 1244 to read as follows:
     3    §  1244.  Battery pack; fireproof blanket. 1. Every bicycle with elec-
     4  tric assist shall be sold with  a  fiberglass  fireproof  blanket  which
     5  shall  be  used  when  charging  the bicycle with electric assist. Every
     6  person charging a bicycle with electric assist shall place the  lithium-
     7  ion  battery pack under such fiberglass fireproof blanket, or in a fire-
     8  proof bag or container, while the  charging  is  taking  place.  If  the
     9  battery  cannot  be  removed  from  the bicycle with electric assist and
    10  charged separately, then a fiberglass fireproof blanket shall be  placed
    11  over the entire bicycle with electric assist.
    12    2. Sellers of bicycles with electric assist shall include a fiberglass
    13  fireproof blanket or fireproof bag or container which meets the require-
    14  ments  of  this  section for the particular bicycle with electric assist
    15  being purchased with each purchase of a bicycle with electric assist.
    16    3. A violation of this section shall be punished by  a  fine  of  five
    17  hundred  dollars  for the first violation and an additional five hundred
    18  dollars for each subsequent violation.
    19    § 2. The vehicle and traffic law is amended by adding  a  new  section
    20  1290 to read as follows:
    21    §  1290.  Battery  pack;  fireproof blanket. 1. Every electric scooter
    22  shall be sold with a fiberglass fireproof blanket which  shall  be  used
    23  when  charging  the  electric scooter. Every person charging an electric
    24  scooter shall place the lithium-ion battery pack under  such  fiberglass

     1  fireproof  blanket, or in a fireproof bag or container, while the charg-
     2  ing is taking place. If the battery cannot be removed from the  electric
     3  scooter  and  charged  separately,  then  a fiberglass fireproof blanket
     4  shall be placed over the entire electric scooter.
     5    2.  Sellers  of electric scooters shall include a fiberglass fireproof
     6  blanket or fireproof bag or container which meets  the  requirements  of
     7  this  section  for  the particular electric scooter being purchased with
     8  each purchase of an electric scooter.
     9    3. A violation of this section shall be punished by  a  fine  of  five
    10  hundred  dollars  for the first violation and an additional five hundred
    11  dollars for each subsequent violation.
    12    § 3. This act shall take effect immediately.
