       AN ACT to amend the public service law, in relation  to  requiring  that
         the  public service commission ensure equitable treatment to customers
         of municipalities and cooperatives who purchase power from  the  power
         authority of the state of New York
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. Section 66 of the public service law is amended by adding a
    2  new subdivision 20-a to read as follows:
    3    20-A. IN REVIEWING AND APPROVING ANY PLAN SUBMITTED PURSUANT TO SUBDI-
    4  VISION TWENTY-ONE OF THIS SECTION, THE COMMISSION SHALL ENSURE THAT  THE
    5  PLAN PROVIDES FOR EQUITABLE TREATMENT TO CUSTOMERS OF MUNICIPALITIES AND
    6  COOPERATIVES WHO PURCHASE POWER FROM THE POWER AUTHORITY OF THE STATE OF
    7  NEW  YORK.  IN  ANY REVIEW EVALUATING THE RESPONSE OF AN ELECTRIC CORPO-
    8  RATION TO AN ELECTRIC EMERGENCY,  THE  COMMISSION  SHALL  DETERMINE  THE
    9  EXTENT  TO WHICH THE CORPORATION'S PERFORMANCE REFLECTS EQUITABLE TREAT-
   10  MENT OF CUSTOMERS OF SUCH MUNICIPALITIES AND COOPERATIVES.
   11    S 2. This act shall take effect immediately.
