        AN  ACT  to  amend the highway law, in relation to directing the commis-
          sioner of transportation to prohibit use on any state or local highway
          of certain types of guardrails
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
     1    Section  1.  Section  10 of the highway law is amended by adding a new
     2  subdivision 47 to read as follows:
     3    47. Promulgate rules and regulations prohibiting the use and installa-
     4  tion, on any state or local highway, of any "X-Lite" guardrail  or  rail
     5  cap  manufactured  by the Lindsay Corporation, or any other guardrail or
     6  rail cap of similar design and/or materials as determined by the commis-
     7  sioner.  Additionally, the department shall immediately  act  to  remove
     8  any  existing "X-Lite" guardrail or rail cap manufactured by the Lindsay
     9  Corporation, or any other guardrail or rail cap of similar design and/or
    10  materials as determined by the commissioner.
    11    § 2. This act shall take effect immediately.
