       AN  ACT in relation to establishing the task force to explore the incor-
         poration of the principles of universal design for learning  into  the
         education  systems  in the state; and providing for the repeal of such
         provision upon expiration thereof
         THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section  1. There is hereby created a task force to explore the incor-
    2  poration of the principles of universal design  for  learning  into  the
    3  education systems in New York.
    4    S  2.  (a)  The  membership of the task force shall be as follows: one
    5  member of the senate,  appointed  by  the  temporary  president  of  the
    6  senate;  one  member  of  the  assembly, appointed by the speaker of the
    7  assembly; the commissioner of education, or the commissioner's designee;
    8  the chancellor of the  state  university  system,  or  the  chancellor's
    9  designee; the superintendent of the New York state school for the blind,
   10  or  the  superintendent's  designee;  the superintendent of the New York
   11  state school for the  deaf,  or  the  superintendent's  designee;  three
   12  representatives  of  the state education department from different divi-
   13  sions or bureaus, each appointed by the assistant or  associate  commis-
   14  sioner  of  the  represented division or bureau, of whom:  one represen-
   15  tative  shall  have  expertise   in   instruction   of   students   with
   16  disabilities, and one representative shall have expertise in assessments
   17  and accountability; one board of cooperative educational services super-
   18  intendent; one representative of the division of students with disabili-
   19  ties  and  English  language learners of the New York city department of
   20  education; one member of the citywide council on  special  education  of
   21  the New York city department of education; one member of the commission-
   22  er's  advisory panel for special education services; three public school

    1  teachers who are general educators that teach in  the  state,  one  each
    2  from  an  elementary, a middle, and a high school of whom:  one shall be
    3  certified in special education, and one shall have experience  with  and
    4  be  certified to instruct students with limited English proficiency; one
    5  certified pre-school teacher; one member of the state university of  New
    6  York  administration, appointed by the chancellor of the state universi-
    7  ty; and five members appointed by the governor, at least one of whom has
    8  expertise in universal design for learning.
    9    (b) The governor shall designate the chair of the task force.
   10    (c) Members of the task force shall not receive any  compensation  but
   11  shall be reimbursed for their actual, necessary expenditures.
   12    (d)  Members  of  the  task  force  shall serve at the pleasure of the
   13  person who appointed them. Any vacancy on the task force shall be filled
   14  in the same manner as the original appointment.
   15    (e) The state education department shall provide staff  for  the  task
   16  force.
   17    S 3. All departments or agencies of the state or subdivisions thereof,
   18  and  local  governments  shall, at the request of the chair, provide the
   19  task force such facilities, assistance, and data as will enable the task
   20  force to carry out its powers and duties.
   21    S 4. The task force may meet  and  hold  public  hearings  within  the
   22  regions of the state, and shall have all the powers of an executive body
   23  pursuant to the executive law.
   24    S 5. The task force shall:
   25    (a) study the effectiveness of universal design for learning to:
   26    (i) provide flexibility in the ways information is presented, students
   27  respond  or  demonstrate knowledge and skills, and students are engaged;
   28  and
   29    (ii) reduce barriers in instruction and provide  appropriate  accommo-
   30  dations,  supports,  and  challenges  while maintaining high achievement
   31  expectations for all students, including students with disabilities  and
   32  students with limited English proficiency;
   33    (b) study the feasibility of:
   34    (i)  incorporating and applying the principles of universal design for
   35  learning into the elementary, secondary, and  postsecondary  and  higher
   36  education  systems  in the state with respect to curriculum development;
   37  the evaluation, selection, and design of textbooks  and  other  instruc-
   38  tional  materials;  the purchase and use of technology for instructional
   39  purposes; teacher preparation and staff development; the development  of
   40  classroom, district, and statewide assessments; and state grants; and
   41    (ii) evaluating the effect of universal design for learning on student
   42  outcomes;
   43    (c)  make  recommendations relating to how school districts and boards
   44  of cooperative educational services may incorporate the  best  practices
   45  and  principles of universal design for learning through the development
   46  of local school system policies and procedures, including but not limit-
   47  ed to local educational goals, teaching methods, instructional materials
   48  and assessments.
   49    S 6. The task force shall make a report of its findings to the  gover-
   50  nor, the temporary president of the senate and the speaker of the assem-
   51  bly, within one year of the date of the task force's first meeting. Such
   52  report shall include recommendations for further action and legislation.
   53    S  7.  This act shall take effect July 1, 2013 and shall expire and be
   54  deemed repealed two years after such date.
