PHEFFER -- read once and referred to the Committee on Education AN ACT to amend the education law, in relation to school district resi- dency requirements for students whose parents are activated to mili- tary service THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: 1 Section 1. Subdivision 2 of section 3202 of the education law is 2 amended to read as follows: 3 2. Nonresidents of a district, if otherwise competent, may be admitted 4 into the school or schools of a district or city, upon the consent of 5 the trustees or the board of education, upon terms prescribed by such 6 trustees or board. NOTWITHSTANDING ANY OTHER PROVISION OF LAW TO THE 7 CONTRARY, NONRESIDENT STATUS SHALL NOT APPLY TO A STUDENT WHO SUBSE- 8 QUENTLY BECOMES A NONRESIDENT BECAUSE HE OR SHE MUST RESIDE OUTSIDE OF 9 HIS OR HER SCHOOL DISTRICT TEMPORARILY WHILE ONE OR BOTH PARENTS ARE IN 10 ACTIVE MILITARY SERVICE. 11 S 2.
