        AN ACT to amend the navigation law, in  relation  to  requiring  working
          marine carbon monoxide detectors to be carried on certain boats

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:

     1    Section 1. Section 40 of the navigation law is amended by adding a new
     2  subdivision 9-a to read as follows:
     3    9-a. Marine carbon monoxide detectors.
     4    (a) For the  purposes  of  this  section,  a  marine  carbon  monoxide
     5  detection  system  shall mean a device or system that meets the require-
     6  ments of the current version of the  American  Boat  and  Yacht  Council
     7  Standard A-24, for carbon monoxide detection systems.
     8    (b)  For  the  purpose  of  this  section,  an "enclosed accommodation
     9  compartment" means one contiguous space, surrounded  by  boat  structure
    10  that contains all of the following:
    11    (i) designated sleeping accommodations;
    12    (ii) a galley area with sink; and
    13    (iii) a head compartment.
    14    (c)  For the purposes of this section, "substantial renovations" shall
    15  mean any renovation where the value of renovation work is  equal  to  or
    16  greater than the present market value of the vessel.
    17    (d)  After  the effective date of this subdivision, no new vessel that
    18  has an enclosed accommodation compartment or  a  vessel  that  undergoes
    19  substantial  renovations  may  be  sold or offered for sale in the state
    20  unless such vessel is equipped with  a  new  functioning  marine  carbon
    21  monoxide  detection  system  installed  according  to the manufacturer's
    22  instructions.
    23    § 2. This act shall take effect on the one hundred eightieth day after
    24  it shall have become a law.
