ROSENTHAL, GOTTFRIED -- read once and referred to the Committee on Governmental Operations AN ACT to amend the executive law, in relation to health care proxy information on state agency websites THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: 1 Section 1. Section 104 of the executive law is amended to read as 2 follows: 3 S 104. Departmental cooperation. (A) The secretary of state may advise 4 with the several departments, boards, bureaus, officers, authorities, 5 commissions and other agencies of the state which are authorized by 6 statute to issue codes, rules or regulations, to the end that the same 7 may, so far as possible, be uniform in style and form, be properly 8 numbered and captioned and be free from matter which is obsolete. 9 (B) THE SECRETARY OF STATE SHALL, IN CONSULTATION WITH THE COMMISSION- 10 ER OF HEALTH, ADVISE WITH STATE DEPARTMENTS, BOARDS, BUREAUS, AUTHORI- 11 TIES, COMMISSIONS, DIVISIONS AND OTHER AGENCIES WITH PUBLIC WEBSITES 12 THAT HAVE SIGNIFICANT PUBLIC INTERACTION TO ENSURE THAT EACH CREATES A 13 LINK ON THEIR HOMEPAGE TO HEALTH CARE PROXY INFORMATION ON THE DEPART- 14 MENT OF HEALTH WEBSITE. A STATE DEPARTMENT, BOARD, BUREAU, AUTHORITY, 15 COMMISSION, DIVISION AND AGENCY WHICH DETERMINES THAT THEY DO NOT HAVE 16 SIGNIFICANT PUBLIC TRAFFIC ON THEIR WEBSITE, OR WHICH DETERMINES THAT 17 CREATING SUCH A LINK WOULD BE A FINANCIAL HARDSHIP, MAY BE EXEMPTED FROM 18 THE PROVISIONS OF THIS SUBDIVISION. 19 S 2.
