          RICHARDSON, NIOU -- read once and referred to the Committee on Cities
        AN ACT to amend the general city law, in relation to materials submitted
          in support of applications for an identity card issued by the city  of
          New York
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
     1    Section 1. Legislative intent. The legislature finds and declares that
     2  the city of New York issues a New York city identification  card,  which
     3  provides  government  issued  identification to any resident of the city
     4  who files an application with sufficient proof  of  identity  and  resi-
     5  dence.  The  legislature  further  finds  and  declares that information
     6  submitted when applying for such identification  card  is  protected  as
     7  confidential  by the city of New York. The legislature further finds and
     8  declares that in order to adequately protect the confidentiality of such
     9  applicants, such documents fall within the personal  privacy  and  other
    10  exemptions  of  the  freedom  of information law, and would therefore be
    11  exempt from disclosure. However, due to  the  great  importance  of  the
    12  privacy interests of such applicants, it should be made clear that these
    13  materials are not subject to disclosure under the freedom of information
    14  law.  Accordingly,  the legislature hereby finds and declares that it is
    15  necessary and appropriate to prevent  such  documents  from  being  made
    16  available  for  inspection  and copying under the freedom of information
    17  law and comparable provisions of the New York city charter.
    18    § 2. Subdivision 14 of section 20 of the general city law, as added by
    19  chapter 247 of the laws of 1913, is amended to read as follows:
    20    14. (a) To create, maintain and administer a system or systems for the
    21  enumeration, identification and registration, or either, of the inhabit-

     1  ants of the city and visitors thereto, or such classes thereof as may be
     2  deemed advisable.
     3    (b)  Any  materials  submitted  in support of applications for the New
     4  York city identity card issued pursuant to section 3-115 of the adminis-
     5  trative code of the city of New York shall  be  exempt  from  disclosure
     6  under  article  six  of  the  public  officers law, section one thousand
     7  fifty-eight of the New York  city  charter,  and  section  one  thousand
     8  fifty-nine of the New York city charter.
     9    §  3.  This  act shall take effect immediately, and shall apply to any
    10  request submitted under article 6 of the public officers  law  or  under
    11  section 1058 or 1059 of the New York city charter made on or after Janu-
    12  ary 12, 2015.
