       AN ACT to amend the public health law, in relation to requiring prospec-
         tive employees of nursing homes and home  care  services  agencies  to
         undergo a physical and psychological examination
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. The public health law is amended by adding  a  new  section
    2  2899-b to read as follows:
    3    S  2899-B.  REQUIREMENTS  FOR  PROSPECTIVE EMPLOYEES. A PROVIDER SHALL
    4  REQUIRE THAT ALL PROSPECTIVE EMPLOYEES OF NURSING HOMES  AND  HOME  CARE
    5  SERVICES  AGENCIES  WHO  WILL  BE  CARING  FOR PATIENTS WITH DEMENTIA BE
    6  REQUIRED TO COMPLETE AND PASS A PHYSICAL AND  PSYCHOLOGICAL  EXAMINATION
    7  PRIOR TO BEING HIRED BY SUCH PROVIDER.
    8    S 2. This act shall take effect immediately.
