         tee on Tourism, Arts and Sports Development
       AN ACT to amend the parks, recreation and historic preservation law  and
         the environmental conservation law, in relation to the survey of snow-
         mobile trails
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. The parks, recreation  and  historic  preservation  law  is
    2  amended by adding a new section 21.09 to read as follows:
    3    S 21.09 SURVEY OF SNOWMOBILE TRAILS. 1. THE COMMISSIONER, IN CONSULTA-
    4  TION WITH THE COMMISSIONER OF ENVIRONMENTAL CONSERVATION, SHALL CAUSE TO
    5  BE  TAKEN  A  SURVEY  OF ALL TRAILS IN NEW YORK STATE THAT ARE CURRENTLY
    6  DESIGNATED FOR SNOWMOBILE  OPERATION.  NO  TRAIL  DESIGNATION  SHALL  BE
    7  REVOKED  FOR THE PURPOSES OF ALTERING SURVEY RESULTS, AND NO TRAIL MILE-
    8  AGE MAY BE ADDED UNTIL  SUCH  SURVEY  IS  COMPLETED.  FURTHERMORE,  SUCH
    9  SURVEY  SHALL  INCLUDE  ALL  TRAILS DESIGNATED FOR SNOWMOBILE USE IN THE
   10  FOREST PRESERVE, AND THE TRANSFER OR REVOCATION OF EXISTING DESIGNATIONS
   11  FOR SNOWMOBILE TRAIL USE IN THE FOREST PRESERVE MAY NOT OCCUR  IN  ORDER
   12  TO MODIFY THE RESULTS OF SUCH SURVEY.
   13    2.  NO  ACTION ON SNOWMOBILE TRAIL USE POLICY MAY OCCUR, NOR SHALL THE
   14  IMPLEMENTATION OF ANY COMPREHENSIVE SNOWMOBILE TRAIL POLICY OCCUR  UNTIL
   15  SUCH SURVEY HAS BEEN COMPLETED, AND THE RESULTS HAVE BEEN MADE PUBLIC.
   16    3. THE COMMISSIONER, IN CONSULTATION WITH THE COMMISSIONER OF ENVIRON-
   17  MENTAL  CONSERVATION,  SHALL  CAUSE SUCH SURVEY TO BE COMPLETED NO LATER
   18  THAN ONE YEAR AFTER THE EFFECTIVE DATE OF THIS SECTION.
   19    S 2. The environmental conservation law is amended  by  adding  a  new
   20  section 9-0115 to read as follows:
   21  S 9-0115. SURVEY OF SNOWMOBILE TRAILS.
   22    NO  ACTION  ON  SNOWMOBILE TRAIL USE POLICY WITHIN THE FOREST PRESERVE
   23  MAY OCCUR, NOR SHALL THE IMPLEMENTATION OF ANY COMPREHENSIVE  SNOWMOBILE
   24  TRAIL  POLICY  OCCUR  UNTIL  A  SNOWMOBILE TRAIL MILEAGE SURVEY HAS BEEN
   25  COMPLETED PURSUANT TO SECTION 21.09 OF THE PARKS, RECREATION AND HISTOR-
   26  IC PRESERVATION LAW.
   27    S 3. This act shall take effect immediately.
