        AN ACT to amend the public authorities law, in  relation  to  increasing
          the membership of the board of the city of Yonkers parking authority

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:

     1    Section 1. Section 1596-c of the public authorities law, as  added  by
     2  chapter 673 of the laws of 1964, is amended to read as follows:
     3    §  1596-c.  City  of Yonkers parking authority. A board to be known as
     4  "City of Yonkers parking authority" is hereby created. Such board  shall
     5  be  a  body  corporate and politic, constituting a public benefit corpo-
     6  ration, and its existence shall commence upon  the  appointment  of  the
     7  members  as  [herein]  provided in this section.   It shall consist of a
     8  chairman, appointed by the mayor of the city of Yonkers, and [four]  six
     9  other  members, who shall also be appointed by the mayor.  The [appoint-
    10  ment of the] chairman shall [be] serve for a term of five years [and  of
    11  each  of  the  other members for terms of one, two, three and four years
    12  from the first day of April, nineteen hundred sixty-four. At the expira-
    13  tion of such terms, the terms of office of  their  successors  shall  be
    14  five years so that the term of office of one-fifth of such members shall
    15  expire  on the thirty-first day of March in each year]; provided, howev-
    16  er, of the two offices of members established pursuant to the chapter of
    17  the laws of two thousand  twenty-one  that  amended  this  section,  one
    18  member  shall  be  appointed for a term to commence on the day of his or
    19  her appointment by the mayor and which shall expire on the  thirty-first
    20  day  of March, two thousand twenty-two and one member shall be appointed
    21  for a term to commence on the day of his or her appointment by the mayor
    22  and which shall expire on the thirty-first day of  March,  two  thousand
    23  twenty-three.  Each member shall continue to serve until the appointment
    24  and qualification of his or her successor.    Vacancies  in  such  board
    25  occurring otherwise than by the expiration of such term, shall be filled

     1  for  the  unexpired term. Nothing in this section shall preclude current
     2  members, as of June first, two thousand twenty-one, from serving out the
     3  remainder of their term. The members of  the  board  shall  choose  from
     4  their  number  a  vice-chairman.  The mayor may remove any member of the
     5  board for inefficiency, neglect of duty or misconduct in office,  giving
     6  him  or  her a copy of the charges against him or her and an opportunity
     7  of being heard in person, or by counsel, in his or her defense upon  not
     8  less  than  ten days' notice. The members of the board shall be entitled
     9  to  no  compensation  for  their  services  but  shall  be  entitled  to
    10  reimbursement  for  their  actual and necessary expenses incurred in the
    11  performance of their official duties. The powers of the authority  shall
    12  be  vested  in  and  exercised by a majority of the members of the board
    13  then in office. Such board may delegate to one or more of its members or
    14  to its officers, agents and employees such powers and duties as  it  may
    15  deem  proper. Such board and its corporate existence shall continue only
    16  to the thirty-first day of December, nineteen hundred  ninety-nine,  and
    17  thereafter  until  all  its liabilities have been met and its bonds have
    18  been paid in full or such  liabilities  or  bonds  have  otherwise  been
    19  discharged.  Upon  its  ceasing  to exist, all its rights and properties
    20  shall pass to the city.
    21    § 2. This act shall take effect immediately.
