STATE OF NEW YORK ________________________________________________________________________ 3348 2017-2018 Regular Sessions IN ASSEMBLY January 27, 2017 ___________ Introduced by M. of A. ENGLEBRIGHT, GOTTFRIED, PERRY -- read once and referred to the Commit- tee on Agriculture AN ACT to amend the agriculture and markets law, in relation to improv- ing shelter care The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Subdivision 3 of section 117 of the agriculture and markets 2 law, as added by chapter 220 of the laws of 1978 and such section as 3 renumbered by section 12 of part T of chapter 59 of the laws of 2010, is 4 amended to read as follows: 5 3. [Each] For each dog seized in accordance with the provisions of 6 this article [shall be properly sheltered, fed and watered for the7redemption period as hereinafter provided], the dog control officer or 8 peace officer, acting pursuant to their special duties, or police offi- 9 cer in the employ of or under contract to a municipality, or any duly 10 incorporated society for the prevention of cruelty to animals, duly 11 incorporated humane society, pound or shelter that is operated by or 12 under contract to a municipality and is taking possession of such dog, 13 whichever has possession of the dog shall: 14 (a) promptly inspect each dog following any seizure and promptly 15 ensure dogs are provided with care and treatment to relieve any pain and 16 suffering, including necessary immediate veterinary care and treatment 17 and parasite control, and appropriate vaccinations, and 18 (b) during the time the dog is in the possession, care or control of 19 such officer, society, pound or shelter, properly shelter and feed each 20 dog, and make accessible at all times potable, non-frozen water to each 21 dog. 22 § 2. Section 373 of the agriculture and markets law is amended by 23 adding a new subdivision 1-b to read as follows: EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. Any officer, agent or society as described in subdivision one of 2 this section or pound or shelter operated by or under contract to a 3 municipality that is taking possession of a lost, stray or homeless 4 animal under the provisions of this section, whichever has possession of 5 the animal during the applicable period, shall: 6 (a) promptly inspect each such animal after taking possession and 7 promptly provide the animal with care and treatment to relieve any pain 8 and suffering, including necessary immediate veterinary care and treat- 9 ment and parasite control, and appropriate vaccinations; and 10 (b) during the time the animal is in the possession, care or control 11 of such officer, society, pound or shelter, properly shelter and feed 12 each animal, and make accessible at all times potable, non-frozen water 13 to each animal. 14 § 3. The agriculture and markets law is amended by adding a new 15 section 125 to read as follows: 16 § 125. Surrendered dogs. 1. For each dog surrendered by its owner, any 17 duly incorporated society for the prevention of cruelty to animals, duly 18 incorporated humane society, pound or shelter that is operated by or 19 under contract to a municipality and is taking possession of such dog, 20 whichever has possession of the dog shall: 21 (a) promptly inspect each dog following any seizure and promptly 22 ensure dogs are provided with care and treatment to relieve any pain and 23 suffering, including necessary immediate veterinary care and treatment 24 and parasite control, and appropriate vaccinations, and 25 (b) during the time the dog is in the possession, care or control of 26 such officer, society, pound or shelter, properly shelter and feed each 27 dog, and make accessible at all times potable, non-frozen water to each 28 dog. 29 § 4.This act shall take effect on the thirtieth day after it shall 30 have become a law.
