       AN  ACT  to amend the highway law, in relation to authorizing the place-
         ment of smoke free school zone signs
         THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section  1.  The highway law is amended by adding a new section 318 to
    2  read as follows:
    3    S 318. SMOKE FREE SCHOOL ZONE SIGNS. ANY POLITICAL SUBDIVISION OF  THE
    4  STATE  HAVING  JURISDICTION  OVER  ANY HIGHWAY WITHIN SCHOOL GROUNDS, AS
    5  DEFINED IN SUBDIVISION FOURTEEN OF SECTION 220.00 OF THE PENAL LAW, MAY,
    6  UPON THE REQUEST OF THE APPROPRIATE SCHOOL AUTHORITY, PLACE, CAUSE TO BE
    7  PLACED OR PERMIT TO BE PLACED WITHIN THE RIGHT OF WAY  OF  SUCH  HIGHWAY
    8  SIGNS INDICATING A SMOKE FREE SCHOOL ZONE.
    9    S 2. This act shall take effect immediately.
