       AN ACT to amend the general business law, in  relation  to  the  use  of
         global positioning systems by car rental companies
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. Section 396-z of the general business  law  is  amended  by
    2  adding a new subdivision 12-a to read as follows:
    3    12-A.  NO  RENTAL  VEHICLE  COMPANY SHALL UTILIZE A GLOBAL POSITIONING
    4  SYSTEM TO TRACK AN  AUTHORIZED  DRIVER  IN  ORDER  TO  IMPOSE  FINES  OR
    5  SURCHARGES RELATING TO SUCH DRIVER'S USE OF THE RENTAL VEHICLE.
    6    S 2. This act shall take effect immediately; provided however that the
    7  amendments  to section 396-z of the general business law made by section
    8  one of this act shall survive the repeal and reversion of  such  section
    9  as provided by section 4 of chapter 656 of the laws of 2002, as amended.
