STATE OF NEW YORK ________________________________________________________________________ 3103 2017-2018 Regular Sessions IN ASSEMBLY January 26, 2017 ___________ Introduced by M. of A. McKEVITT, GRAF, MONTESANO -- Multi-Sponsored by -- M. of A. RA -- read once and referred to the Committee on Codes AN ACT to amend the criminal procedure law, in relation to corporate defendants The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Section 600.20 of the criminal procedure law is amended to 2 read as follows: 3 § 600.20 Corporate defendants; prosecution thereof. 4 At all stages of a criminal action, from the commencement thereof 5 through sentence, a corporate defendant must appear by counsel. Upon 6 failure of appearance at the time such defendant is required to enter a 7 plea to the accusatory instrument, the court may enter a plea of guilty 8 and impose sentence. Upon finding a corporate defendant liable, the 9 district attorney may simultaneously file a civil judgment against such 10 corporate defendant. 11 § 2. This act shall take effect immediately.
