       AN ACT to amend the election law, in relation to the number and  use  of
         voting  machines  in village elections and providing for the repeal of
         such provisions upon expiration thereof
         THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section  1.  Section 15-114 of the election law, as amended by chapter
    2  373 of the laws of 1978, is amended to read as follows:
    3    S 15-114. Number AND USE of voting machines. 1. Any village  that  HAS
    4  NOT  ADOPTED  A RESOLUTION PURSUANT TO PARAGRAPH C OF SUBDIVISION ONE OF
    5  SECTION 15-104 OF THIS ARTICLE AND uses voting machines, INCLUDING LEVER
    6  VOTING MACHINES, for village elections shall provide one voting  machine
    7  for  each  eight hundred or fraction thereof of qualified voters in each
    8  election district, as such voters are defined in section 15-110 of  this
    9  article.
   10    2.  NOTHING IN THIS SECTION SHALL BE CONSTRUED TO REQUIRE THE BOARD OF
   11  ELECTIONS TO MAINTAIN THE CARE,  CUSTODY  OR  CONTROL  OF  LEVER  VOTING
   12  MACHINES.
   13    S  2.  This  act shall take effect immediately and shall expire and be
   14  deemed repealed December 31, 2012.
