       AN ACT to amend the real property tax law, in relation to  the  duration
         of  the  exemption  and  income  level of eligible senior citizens for
         purposes of the school tax  relief  (STAR)  exemption  and  to  repeal
         certain  provisions of such law relating to the income level of senior
         citizens eligible for such exemption
         THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section  1.  Paragraph (b) of subdivision 4 of section 425 of the real
    2  property tax law is REPEALED.
    3    S 2. Subparagraph (ii) of paragraph (a) of subdivision 13  of  section
    4  425  of  the  real  property tax law, as added by section 1 of part B of
    5  chapter 389 of the laws of 1997, is amended to read as follows:
    6    (ii) in the case of an application  for  the  enhanced  exemption  for
    7  property owned by senior citizens, the applicant or applicants misrepre-
    8  sented  their  age  [or  income]  so  as  to  appear  eligible  for such
    9  exemption, when they were not.
   10    S 3. This act shall take effect on the ninetieth day  after  it  shall
   11  have become a law.
