       AN ACT to amend the New York state printing and public documents law and
         the state technology law, in relation to agency reports
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. Subdivision 4 of section 12 of the New York state  printing
    2  and  public  documents law, as added by chapter 278 of the laws of 2012,
    3  is amended to read as follows:
    4    4. (a) Whenever state law requires a  state  agency  to  make,  issue,
    5  submit,  deliver, distribute or forward a report to the "legislature" or
    6  to "members of the legislature" or to "both houses of the  legislature,"
    7  or to any particular legislative officers or chairpersons of legislative
    8  committees,  subcommittees or commissions, the agency shall satisfy such
    9  requirement by:
   10    (i) [making, issuing, submitting, delivering, distributing or forward-
   11  ing a printed copy of the report to each member of the  legislature,  or
   12  to  the  specified legislative officers or chairpersons, as the case may
   13  be; if such report contains confidential information or is provided with
   14  the understanding that further disclosure of certain information in such
   15  reports is prohibited, provided that, such report shall be posted to the
   16  agency's website with all such confidential  information  redacted;  or]
   17  MAKING  SUCH  DOCUMENT  AVAILABLE ON THE NEW YORK STATE AGENCY DOCUMENTS
   18  WEBSITE, AS AUTHORIZED BY SUBDIVISION EIGHTEEN OF  SECTION  ONE  HUNDRED
   19  THREE  OF THE STATE TECHNOLOGY LAW, UNDER THE APPROPRIATE AGENCY'S HEAD-
   20  ING AND SENDING A PRINTED LETTER OR NOTICE TO EACH MEMBER OF THE  LEGIS-
   21  LATURE, OR TO THE SPECIFIED LEGISLATIVE OFFICERS OR CHAIRPERSONS, AS THE
   22  CASE MAY BE, INDICATING THE AVAILABILITY OF SUCH REPORT ON THIS WEBSITE;
   23  AND BY
        EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets

    1    (ii)  making  such  document  available  on  its website and sending a
    2  printed letter or notice to each member of the legislature,  or  to  the
    3  specified  legislative  officers  or  chairpersons,  as the case may be,
    4  indicating the availability of such report on the agency's website.
    5    (b)  Such  letter  or  notice  shall  include the name of the specific
    6  report, the specific web address at which the report can be accessed  or
    7  instructions on how to access the report from the agency's homepage, and
    8  the  name  of  the person at the state agency to whom the legislator may
    9  direct a request to obtain a printed copy of the report, free of charge,
   10  if so desired.
   11    S 2. Section 103 of the state technology law is amended  by  adding  a
   12  new subdivision 18 to read as follows:
   13    18.  TO  ESTABLISH,  ADMINISTER  AND  MAINTAIN A NEW YORK STATE AGENCY
   14  DOCUMENTS WEBSITE WHICH WILL INCLUDE POSTINGS OF ALL REPORTS  ISSUED  BY
   15  STATE  AGENCIES,  DEPARTMENTS, PUBLIC AUTHORITIES, PUBLIC BENEFIT CORPO-
   16  RATIONS OR ENTITIES WHENEVER STATE LAW REQUIRES A STATE AGENCY TO  MAKE,
   17  ISSUE,  SUBMIT, DELIVER, DISTRIBUTE OR FORWARD A REPORT TO THE "LEGISLA-
   18  TURE" OR TO "MEMBERS OF THE LEGISLATURE"  OR  TO  "BOTH  HOUSES  OF  THE
   19  LEGISLATURE",  OR TO ANY PARTICULAR LEGISLATIVE OFFICERS OR CHAIRPERSONS
   20  OF LEGISLATIVE COMMITTEES, SUBCOMMITTEES OR COMMISSIONS. IT SHALL BE THE
   21  RESPONSIBILITY OF THE NEW YORK STATE AGENCY DOCUMENTS WEBSITE  TO  SERVE
   22  AS THE CENTRAL REPOSITORY FOR THE POSTING AND ARCHIVING OF ALL DOCUMENTS
   23  PROVIDED TO THE LEGISLATURE AS REQUIRED BY STATE LAW.
   24    S 3. This act shall take effect on the one hundred twentieth day after
   25  it shall have become a law.
