COLTON, PERRY, RIVERA -- read once and referred to the Committee on Social Services AN ACT establishing a moratorium on the site selection of state facili- ties in cities of one million or more THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: 1 Section 1. Notwithstanding any other provision of law, in a city with 2 a population of one million or more, no new site selection or the open- 3 ing of state facilities shall be commenced or completed from the effec- 4 tive date of this act until there has been completed a comprehensive 5 review by the governor or his designee of all existing and proposed 6 state facilities. Such review shall include, but not be limited to, an 7 assessment of the oversaturation of communities within a half mile radi- 8 us within such city with state facilities. The governor shall establish 9 a plan for correcting the oversaturation of state facilities in such 10 communities. Such review and plan shall be completed by January 1, 2016 11 and shall be prepared for submission to the legislature on or before 12 such date. 13 S 2. For the purposes of this act: 14 (a) "State facility" shall mean and include a group home as defined in 15 section 371 of the social services law and a residential facility as 16 defined in section 473-d of the social services law. 17 (b) "State services" shall mean services provided by the state for the 18 benefit of its residents, including but not limited to, residential 19 facilities, community residences, services for the aged, blind or disa- 20 bled, community centers and services for seniors, homeless housing and 21 assistance programs, child care resources and referral programs, drug 22 rehabilitation services and youth centers. 23 (c) "Oversaturation" shall be measured by and be based on the number 24 of residential beds within a half mile radius, such number of beds EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD06615-01-5 A. 1349 2 1 should not exceed 50; the amount of traffic caused by the siting of a 2 state facility; the number of persons sought to be serviced by such 3 facility; and any other factors that may change the character of the 4 community and have an impact on the environment. 5 S 3. This act shall take effect immediately.
