STATE OF NEW YORK ________________________________________________________________________ 604 2023-2024 Regular Sessions IN ASSEMBLY January 9, 2023 ___________ Introduced by M. of A. PAULIN -- read once and referred to the Committee on Governmental Operations AN ACT to amend chapter 566 of the laws of 2019, authorizing the commis- sioner of general services to transfer and convey certain state land to the city of New Rochelle, in relation to the use of the property for the construction of municipal fire services and affordable hous- ing; and extending the authority of the commissioner of general services to transfer and convey certain lands to the city of New Rochelle The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Section 5 of chapter 566 of the laws of 2019, authorizing 2 the commissioner of general services to transfer and convey certain 3 state land to the city of New Rochelle, as amended by section 1 of 4 subpart C of part XX of chapter 55 of the laws of 2020, is amended to 5 read as follows: 6 § 5. Any lands transferred pursuant to this act shall be used for the 7 purposes of the city of New Rochelle to utilize the subject property 8 exclusively for the construction of municipal [facilities, specifically9a city hall building] fire services and affordable housing located in 10 the city of New Rochelle, which solely for the purposes of this act, 11 shall mean that one hundred percent of the rental dwelling units in the 12 building shall, upon initial rental and upon each subsequent rental 13 following a vacancy, be affordable to and restricted to occupancy by 14 individuals or families in accordance with a plan developed and approved 15 by the commissioner of the New York state division of homes and communi- 16 ty renewal, and upon termination of such use, title to the lands so 17 transferred shall revert to the state of New York. In lieu of such 18 reversion, the city of New Rochelle may purchase the reverter interest 19 in the subject property at the current fair market values less the value EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. Section 6 of chapter 566 of the laws of 2019, authorizing the 4 commissioner of general services to transfer and convey certain state 5 land to the city of New Rochelle, as amended by chapter 195 of the laws 6 of 2022, is amended to read as follows: 7 § 6. This act shall take effect immediately; provided however, that 8 the authority of the commissioner of general services to transfer and 9 convey the aforesaid lands and improvements pursuant to this act shall 10 expire December 31, [2022] 2024. 11 § 3. This act shall take effect immediately and shall be deemed to 12 have been in full force and effect on and after December 30, 2022.
