       AN ACT to amend the environmental conservation law, in relation to prep-
         aration of environmental impact statements
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. The opening paragraph of subdivision 2 of section 8-0109 of
    2  the environmental conservation law, as amended by  chapter  219  of  the
    3  laws of 1990, is amended to read as follows:
    4    All  agencies  [(or applicant as hereinafter provided)] shall prepare,
    5  or cause to be prepared by contract or otherwise an environmental impact
    6  statement on any action they propose or approve which may have a signif-
    7  icant effect on the environment.  SUCH STATEMENT SHALL BE PREPARED BY AN
    8  INDEPENDENT ENTITY NOT RELATED OR IN ANY WAY ASSOCIATED WITH THE  APPLI-
    9  CANT,   OR  THE  FIRM  UNDER  CONTRACT  FOR  THE  DESIGN,  START  UP  OR
   10  CONSTRUCTION OF THE PROPOSED ACTION OR  PLAN.  Such  a  statement  shall
   11  include a detailed statement setting forth the following:
   12    S 2. This act shall take effect immediately.
