       AN  ACT  to  amend  the  executive  law and the general business law, in
         relation to the  bicycle  theft  prevention  awareness  and  education
         program
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. Subdivision 3 of  section  553  of  the  executive  law  is
    2  amended by adding a new paragraph l to read as follows:
    3    1.  ESTABLISH  A  BICYCLE  THEFT  PREVENTION  AWARENESS  AND EDUCATION
    4  PROGRAM PURSUANT TO SECTION THREE HUNDRED NINETY-ONE-CC OF  THE  GENERAL
    5  BUSINESS LAW.
    6    S  2. The general business law is amended by adding a new section 391-
    7  cc to read as follows:
    8    S 391-CC. BICYCLE THEFT PREVENTION AWARENESS AND EDUCATION PROGRAM. 1.
    9  THE EXECUTIVE DIRECTOR OF THE STATE CONSUMER PROTECTION BOARD, ON BEHALF
   10  OF THE STATE CONSUMER PROTECTION BOARD, HEREAFTER REFERRED  TO  IN  THIS
   11  SECTION  AS  THE  "BOARD," AND IN CONJUNCTION WITH THE DIVISION OF STATE
   12  POLICE AND IN CONSULTATION WITH THE NEW YORK CITY POLICE DEPARTMENT  AND
   13  NEW  YORK CITY DEPARTMENT OF CONSUMER AFFAIRS, SHALL DEVELOP, IMPLEMENT,
   14  AND MAINTAIN AN ONGOING PUBLIC AWARENESS AND EDUCATION PROGRAM TO INFORM
   15  THE GENERAL PUBLIC OF SYSTEMS AND METHODS DESIGNED  TO  PREVENT  BICYCLE
   16  THEFT,  INCLUDING,  BUT  NOT  LIMITED TO, PROPER METHODS FOR PARKING AND
   17  LOCKING BICYCLES, THE BENEFITS OF BICYCLE REGISTRATION, AND  THE  PROPER
   18  PROCEDURE FOR REPORTING BICYCLE THEFT.
   19    2.  THE  EXECUTIVE  DIRECTOR  SHALL PRODUCE AND DISTRIBUTE EDUCATIONAL
   20  MATERIALS RELATED TO BICYCLE  THEFT  PREVENTION.  SUCH  MATERIALS  SHALL
        EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets

    1  INCLUDE REFERENCE TO BICYCLE REGISTRATION PROGRAMS ADMINISTERED BY MUNI-
    2  CIPALITIES AND OTHER APPROPRIATE ENTITIES. SUCH MATERIALS  SHALL BE MADE
    3  AVAILABLE,  UPON  REQUEST, TO LAW ENFORCEMENT AGENCIES, EDUCATION INSTI-
    4  TUTIONS,  COMMUNITY  GROUPS,  AND MUNICIPALITIES. THE EXECUTIVE DIRECTOR
    5  SHALL ALSO POST OR CAUSE TO BE POSTED THE CONTENTS OF  SUCH  EDUCATIONAL
    6  MATERIALS ON THE BOARD'S INTERNET WEBSITE.
    7    3. THE BOARD SHALL PERIODICALLY REVIEW AVAILABLE DATA ON BICYCLE THEFT
    8  AND  UPDATE  THE  INFORMATION  ON  BICYCLE  THEFT  PREVENTION  AWARENESS
    9  PROVIDED  IN ITS EDUCATIONAL MATERIALS AND ON ITS INTERNET  WEBSITE,  AS
   10  APPROPRIATE.
   11    4.  THE  BOARD  SHALL ISSUE A WRITTEN REPORT, ON OR BEFORE APRIL FIRST
   12  NEXT SUCCEEDING THE DATE ON WHICH THIS SECTION SHALL HAVE BECOME  A  LAW
   13  TO  THE  GOVERNOR, THE TEMPORARY PRESIDENT OF THE SENATE AND THE SPEAKER
   14  OF THE ASSEMBLY ON THE IMPLEMENTATION OF THIS SECTION AND ANY  RECOMMEN-
   15  DATIONS FOR FURTHERING THE PURPOSE OF THIS SECTION.
   16    S 3. This act shall take effect immediately.
