Summary

Provides that the Commissioner of the Department of Environmental conservation shall approve an adequacy of source evaluation submitted by each applicant for certification or recertification of an in-state bottled water facility before such certification or recertification may be issued by the Department of Health. The adequacy of source evaluation would assess the potential impact on the existing water source, and provide reasonable assurances that the proposed water extractions would not adversely impact the water source or violate the property rights of neighboring property owners. Under the bill, the Commissioner of the Department of Health could not issue a certification to establish a bottled water facility, or re-certification of an existing facility, where water is proposed to be or is presently extracted from an in-state water source, unless the applicant: 1) meets current regulations and standards for bottled and bulk water under the State Sanitary Code; and 2) submits an adequacy of source evaluation, approved by the Commissioner of Environmental Conservation.
