SYNOPSIS

     "Anti-Snow Dumping Act"; prohibits commercial snowplow operators on private property from depositing snow in public roads, streets, and highways or on public lands.

     As reported by the Assembly Transportation, Public Works and Independent Authorities Committee on May 23, 2011, with amendments.

  


An Act concerning the removal of snow from private property and supplementing Title 39 of the Revised Statutes.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    a.  This act shall be known and may be cited as the "Anti-Snow Dumping Act."

     b.    The 1commercial1 operator of any snowplow, or other snow removal equipment, clearing accumulated snow on private property shall not deposit, or cause to be deposited, such snow on any public road, street, or highway in this State or on public lands.  1[An] A commercial1 operator of any snowplow or other snow removal equipment who fails to comply with the provisions of this section shall be liable to a fine of $250 for the first offense, and for each subsequent offense, a fine of $500.

 

     2.    This act shall take effect immediately.
