SYNOPSIS

     Increases membership and provides for certain meeting requirements of Council on Local Mandates.

An Act concerning the Council on Local Mandates, including membership and meeting requirements, and amending P.L.1996, c.24.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    Section 4 of P.L.1996, c.24 (C.52:13H-4) is amended to read as follows:

     4.    Pursuant to Article VIII, Section II, paragraph 5(b) of the New Jersey Constitution, there is created a Council on Local Mandates.  The council shall consist of [nine] 12 public members[.  The] , as follows: 

     a.     the Governor shall appoint four members, at least two of whom shall be appointed from a list of six willing nominees submitted by the chair of the State committee of the political party the gubernatorial candidate of which received the second largest number of votes cast in the most recent general election for Governor[.  The] ;

     b.    the President of the Senate, the Minority Leader of the Senate, the Speaker of the General Assembly, the Minority Leader of the General Assembly, and the Chief Justice of the New Jersey Supreme Court shall each appoint one member; and

     c.     the Governor shall, notwithstanding the appointment requirements described pursuant to section 6 of P.L.1996, c.24 (C.52:13H-6), appoint three members upon the recommendation of the executive director the New Jersey State League of Municipalities, two of whom may be current local elected officials, and one of whom shall be a member of the New Jersey Association of Counties.

     2.    Section 14 of P.L.1996, c.24 (C.52:13H-14) is amended to read as follow:

     14.  a.  The council shall not be subject to the provisions of the "Open Public Meetings Act," P.L.1975, c.231 (C.10:4-6 et seq.).  The council shall conduct proceedings at which it examines witnesses and receives evidence in public.  However, the members of the council may meet on all other matters in closed session.

     b.    The council shall meet at least quarterly to review the State budget and any executive order of the Governor it deems appropriate, and following each review shall publish an opinion on the topics reviewed, to be made available to members of the public in a form and manner to be determined by the council.

     3.    This act shall take effect immediately.

 

 

STATEMENT

 

     This bill amends existing law to increase the Council on Local Mandates (council) membership to 12 members and requires the Governor to appoint three members upon certain recommendations of the executive director of the New Jersey State League of Municipalities.  The bill also requires the council to meet at least quarterly to review and provide an opinion to be made available to the public concerning the State budget and any executive order of the Governor it deems appropriate.
