     Permits Commissioner of Transportation to adopt regulations limiting the operation of certain commercial motor vehicles.

An Act permitting the Commissioner of Transportation to adopt regulations concerning certain commercial motor vehicles.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.  Notwithstanding any law, rule, or regulation to the contrary, the Commissioner of Transportation may adopt regulations limiting the operation of commercial motor vehicles upon that portion of County Route No. 50 located in Monmouth county.  In adopting regulations, the commissioner shall give consideration to normal traffic volume, including that of commercial motor vehicles, the feasibility and safety of traffic management, the number of residences and businesses that would be impacted by the regulations, the impact on the environment, and any other factor the commissioner deems relevant in adopting regulations.

     For the purposes of this section:

     "Commercial motor vehicle" means and includes every type of motor-driven vehicle used for commercial purposes on the highways, such as the transportation of goods, wares and merchandise, excepting such vehicles as are run only upon rails or tracks and vehicles of the passenger car type used for touring purposes or the carrying of farm products and milk, as the case may be, and shall also include vehicles registered as "construction," "solid waste," or a combination of vehicles of which the "constructor" or "solid waste" vehicle is the drawing vehicle.

 

     2.  This act shall take effect immediately.

 

 

STATEMENT

 

     This bill permits the Commissioner of Transportation to adopt regulations limiting the operation of commercial motor vehicles upon that portion of County Route No. 50 located in Monmouth county.  The commissioner, in adopting the regulations, is to give consideration to normal traffic volume, including that of commercial motor vehicles, the feasibility and safety of traffic management, the number of residences and businesses that would be impacted by the regulations, the impact on the environment, and any other factor the commissioner deems relevant.
